Student protest during the Free Days of the Academy at the University of Warsaw (June 
2018) ---- On June 14, a founding meeting of the Workers' Initiative Commission at the 
University of Warsaw took place. Less than three weeks later, on the night of July 3 and 
4, the Sejm of the Republic of Poland passed a new law on higher education, called by its 
creators a "constitution for science" or, tuning into a nomenclature of somewhat outdated 
technological trends, "Law 2.0". Because we know the anti-democratic practices of the 
ruling party, neither the nocturnal mode nor the moment of passing at the beginning of 
academic holidays, when it was difficult to uphold the resistance of students and academic 
teachers who blocked the enactment of the law in June. Where did this rush come from when 
we introduced the clearly unaddressed and negligently corrected for the last moment of the 
act? What roused the protesters all over Poland? What are and will be the consequences of 
the introduction of the new law? How will we organize IPC activities at the University of 
Warsaw in connection with this already happening process?

Minister Jaroslaw Gowin tries to show himself as the savior of Polish higher education, 
although it is difficult to understand what makes him think about himself that way. The 
main and affecting the fertile ground in neo-liberal environments, the argument confirming 
the breakthrough of the new law is an attempt to match the western universities in 
rankings created mainly on the basis of scored publications, research projects, etc. In 
short, it has to be like in America. Reorganization of the university, change of scores 
(defined by regulations and not by law) favoring conservative magazines and publications, 
centralization of management, closer relationship with employers' organizations and 
business, finally separation of flagship centers (about ten in the whole country) from

It is astonishing to consider such ideas revolutionary. They are a rather unreflective and 
radicalized follow-up to the ideas of the two ministerial terms implemented this year by 
the minister Barbara Kudrycka from the Civic Platform, a bit restrained by her successor, 
the minister Lena Kolarska-Bobinska. Minister Gowin defines, like Kudrycka, the problem of 
Polish universities ("you score too few points"), and in fact his answer is also similar 
("we will reorganize you so that you score better"). In the current law there are more or 
less veiled bows towards the employers' organization, the role of commercialization of 
research results is emphasized (it is taken into account as part of the ministerial 
financing of individual universities) or "practical usefulness of work results" for

Taking the example of "Western Colleges", legislators seem to ignore the mass strikes that 
are organized in the largest - as well as less known - academic centers in the United 
Kingdom, the United States, Germany, Denmark, Brazil, Mexico and many other countries. 
Even a short visit to a British or American university makes us realize how much the 
working environment is randomized. A large part of researchers work on short-term grant 
posts, often sponsored by commercial companies, and all work on few "stars", or the 
most-quoted authors, however, like all others, there are strict standards of published 
texts throughout the year. There are advanced procedures to control each stage of work, 
such as the obligation to answer a business e-mail within ten minutes or being subject to 
multilateral evaluation processes (anonymous assessment tests carried out by superiors and 
students). Small, non-commercial or non-commercial units are closed or reorganized due to 
low profitability. In short, the Ministry wants to transfer us to a world from which its

Among the postulates raised by protesters in June, students and scientists also stressed 
the possible politicization of Polish universities. Indeed, the current policy of the 
ministry is a bizarre mixture of neo-liberal and national-Catholic ideologies. The latter 
can be seen, for example, through the special status of the Catholic University of Lublin 
or the promotion of anti-life science through the support of medical studies at the

It is worth noting that the strikers during the Free Days of the Academy in June 2018, the 
newly appointed Works Commission and other opponents of the new Act do not idealize the 
current order, what's more - they identify the announced changes as a continuation of the 
worst practices of today. We ourselves recognize the organization of the university's 
knowledge and work community as a priority, which guarantees respect for the rights of 
employees, employees, students and students. We believe that the objectives of higher 
education will be achieved not by tightening control, but by providing comfortable working 
conditions, an environment for intellectual creativity, which in effect can also serve the 
social world - understood not only as business and employers - outside the academy.

The situation of Polish science seems more dramatic than ever before, and some senior 
professors remembering attempts of state university control before 1989, suggesting that 
the only solution is to wait, internal emigration and building enclaves of knowledge, do 
not seem to notice that the new system oriented it is for meticulous control of behavior 
at the everyday and individual level.

Nevertheless, the resistance and struggle we have so far give us faith in the possibility 
of reversing this situation. First of all, the strikes that broke out across Poland not 
only blocked its adoption for the whole month, but also led to the change of several 
evidently dangerous points, such as the majority participation of representatives of 
employers' organizations in the university councils. This shows that legislators can only 
do as much as they can, and that mobilizes us to further resistance.

Secondly, growing objections at the university created a synergy that allowed for the 
long-established establishment of the Workers' Initiative commission. The Commission has 
decided to use the entire spectrum of methods - from participation in official university 
bodies, through lecture and training activities, to ad hoc intervention activities in 
order to combat the proposed model of work on the creation of knowledge proposed in the 
neoliberal law, based on scoring and exploitation. We urge you to respect employee rights 
and implement real solutions for gender equality at universities. We have begun building a 
multi-branch, cross-border and supranational solidarity, supporting, among others, strike 
at the Berlin Polytechnic. What consequences the new law will have, also depends on us, 
and we are not going to step back a step.

On July 27, at the closed session, the case of one of the employees of Volkswagen Poznan, 
a member of OZZ Inicjatywa Pracownicza, ended. The plaintiff's attorney has just received 
a copy of the verdict. The District Court, as a result of an appeal filed on behalf of the 
employee, awarded him PLN 14 223 as compensation for unlawful termination of the 
employment contract. In addition, the defendant (Volkswagen) charged the costs of the 
proceedings by ordering 712 zlotys to be paid to the State Treasury and refunding the 
plaintiff 30 zlotys for the appeal fee. The verdict is final. ---- Early, the District 
Court in Poznan Grunwald and Jezyce dismissed the employee's claim.  ---- An employee 
represented by a trade union member accused the employer of not consulting the reason for 
termination with his trade union organization. It is true that the employer asked the 
union for information whether the employee (of whom the case) uses the defense of the 
union, however, due to the failure to receive a response within 5 days, he decided that 
there is no obligation to consult our union justifying the termination of the employment 
contract[art. 30 para. 2 (1) of the Trade Unions Act].

Lack of information about the protection was caused by the fact that the employee joined 
the OZZ Employee Initiative during the time limit to provide the employer with information 
about his defense. The employer requested this information on August 23, 2017. The 
employee was not admitted as a member of the union until August 27, 2017. The employer was 
not informed of the trade union's relationship to the IBO on August 29, 2017 - hence, due 
to for the expiry of the deadline, except for the mode referred to in art. 30 para. 2 (1) 
however, the notice of cancellation was made only on 11 September 2017.

During the proceedings, the employer argued that the five-day period referred to in 
Article 30 para. 2 (1) uzz is absolute, and as a result of failure to obtain such 
information, he had the right to withdraw from cooperation with the trade union. Another 
interpretation of this provision would introduce uncertainty in the legal system. On the 
other hand, Volkswagen argued that he had consulted the reason for the dismissal, but with 
the company's Solidarity, to which the plaintiff still formally belonged at the time of 
termination of his contract of employment.

The trade union representative representing the employee from the Employee Initiative 
argued that the employer knew about the union's membership in the IPC of the plaintiff a 
dozen or so days before writing a letter terminating his contract of employment. In 
addition, the defendant learned about the applicant's use of union defense directly from 
the initiative of the organizational structure of the trade union, which did not neglect 
his duty and informed the defendant of the claimant's membership as soon as possible. And 
the mode of art. 30 para. 2 (1) UA would allow the employer to refrain from consulting 
Art. 38 of the Labor Code, only if both under this procedure and from any other reliable 
source would not know about trade union membership.

The court of first instance did not grant the employee the right, he decided that the fact 
of the plaintiff's accession only during the term for informing about his affiliation did 
not matter. Failure to inform the employer within five days of his affiliation released 
the defendant from the obligation to carry out such consultations.

As a result of the appeal filed on behalf of the employee, the Regional Court overruled 
the verdict of the court of first instance. At present, the claimant's plaintiff is 
waiting for his justification. The verdict is legally binding and the employer is obliged 
to pay the plaintiff compensation (the amount indicated in the judgment is not subject to 
taxation or any other deductions). As the proceedings were conducted in a simplified 
procedure, the cassation appeal against it is not due.
