#WORLD #WORLDWIDE #COLUMBIA #ANARCHISM #News #Journal #Update - (en) José Antonio Gutiérrez D: is free, the judicial montage fell! (ca, de, it, fr, pt)[machine translation]

At the hearing on September 6, the crude assembly that the Prosecutor's Office

and the army had been advancing against Harold Ordóñez Botero, reincorporated and
tireless social fighter from Valle del Cauca, fell. In reality, the evidence of
the accusing party, with which they accused him of being "Óscar," commander of
the Adán Izquierdo column of the FARC-EP, did not hold up for a second. It was
clearly a montage, part of a persecution against Harold for his denunciations of
the militarization of rural areas and the continuous abuses that the population
has suffered at the hands of the Palacé Battalion. One more act of revenge
against the peace signatories who have remained firm in their convictions and
committed to continuing to fight (without arms) for the social changes that the
majority are clamoring for in the streets and fields of Colombia.

Harold is free, the judicial montage fell!

Today we celebrate that justice has been done. We are pleased that the judge in
the case, Jenny Brand, acted independently, despite the enormous pressure put on
her by the army, the prosecution and the police. It is still worrying that the
Police Commander, Jorge Luis Vargas, believed he had the right to "dictate" to
the judge the decision she should make, treating her as someone who gives orders
to soldiers in a battalion. On Friday, September 3, when the hearings were still
in progress, the general came out to say that Harold was already with "intramural
insurance" and that he was waiting for "the maximum sentence"[1]. Despite this
clear act of pressure and intimidation, the judge acted on overwhelming evidence
to resolve immediate release for Harold.

In the same way, we must mention the sad role played by the mediocre Colombian
press, which with an unsurprising laziness, limited themselves (except for the
honorable exception of Noticias Uno) to slavishly reproduce the nonsense uttered
by Commander Vargas. Without reviewing the copious evidence in favor of Harold
provided by the brilliant defense attorney Elmer Montaña, they found him guilty
based on the evidence fabricated by the repressive forces, so adept at making
false positives. This shows that for some time the Colombian press has become a
vulgar sounding board for the Paleolithic ultra-right. They deserve to be sued.
Sad also the role of the Comunes party, which contributed to the profile of
Harold for bringing sectarian intrigues and malicious lies to the ears of the
army and the prosecution, fully aware of the consequences. They too are to blame
in this montage. Before, differences were solved by "Comrade Mauser"; now, it is
slander. To date, they have not retracted.

The army, the police and the prosecution have to walk rabones, as they say, and
that same thing makes the situation of Harold continue being worrying and
delicate. In a normal country, this situation would already be clarified and
Harold could continue with his normal life as a worker, student and parent. But
in Colombia there are multiple legal and extra-legal, para-legal mechanisms, with
which to continue harassing, attacking and even murdering people that the
authorities consider annoying. 300 murdered peace signatories are witnesses to
what I say. The "protection" entities in Colombia do not protect, but rather
represent a real threat to the population itself: there are around 7000 confirmed
false positives that prove it.

That is why we cannot lower our vigilance and we must continue to surround Harold
with solidarity to avoid new attacks from a frankly criminal institution. If
something was clear with this trial, it is the enormous affection of all those
who surround Harold, a man rich in friends and colleagues. All those who know
him, as a co-worker, as a fellow in the fight, as family, as friends, went out to
defend him and prevent his name from getting dirty. Harold is a person of clear
convictions, of foolproof transparency, someone who has given everything without
expecting anything in return (that is why he may not have been a good
politician), an honest guy and, above all, a man of dignity. He is neither a
lick-sole, nor a kneeling, nor a shameful repentant, but a social fighter, as he
himself defined in the audience. Dignity produces sympathy,

So let's celebrate freedom, let's celebrate the fall of this montage, but let's
not lose our vigilance. Harold, what a joy to have you back on the street, so
that you continue fighting, so that you continue working for peasant rights and
for the well-being of the poor people, so that you continue to raise the flags of
dignity, so that you continue to give love to your family and everyone around
you. And, of course, so that on September 13 you can defend your master's thesis.
