As the article in Brasil deFato points out, leading millions of Brazilians to lose their investment"deceived by the military" with this private pension experience .2.2 TRAIL OF BLOOD LEFT IN PARANÁ, FROM WOOD FOUNDED BY THE MAISONNAVE GROUPThe land issue is at the heart of the fraud that links the Maisonnave to sectorsof the business community and the military dictatorship. We see the continuity ofthis in the ventures in which the Maisonnave family has ventured. In 1972,through the logging company Maisonnave Giacomet (which was later called Araupel),Roberto Maisonnave led the purchase of a property with an area of over 114thousand hectares of land in southwest Paraná, which belonged to the Ermírio deMorais family, by US $30 million . Roberto Maisonnave proposed to the MFM thepurchase of the area in partnership. At first the military did not agree, butthey agreed to finance the operation .The lands had a dense forest of araucaria and yerba mate, in addition to otherhardwoods, which are documented in ADIM/INCRA Process No. 21500.000994/96-91 of1996. The report also brought the case of Jerônimo,Kaingang, who was kidnapped and tortured by the head of Funai, in order to obtaininformation about the indigenous rebellion.Cases involving loggers, indigenous peoples and squatters are recurrent. Thedocumentary Giacomet Marodin: a history of violence and devastation brings aseries of testimonies from people who dealt with the relationship betweensquatters and the company. We highlight the violent actions against children andpeople who crossed the fences to fish or hunt in so-called company areas. Thedocumentary also denounces the deforestation of native forests and disrespect forresponsible management of the area.Hammel's research proves, based on the history, certificates and transcripts, thepassage of a public heritage to the private domain, in a national protectionarea, whose social function of the land was disregarded due to the interests ofgroups of exploitation of wood for accumulation capital and financialspeculation. Starting in 1973, Giacomet Marodin/Araupel SA made several loans tobanks and financial institutions such as Banco Maisonnave, Banco Sulbrasileiro,Banco Bamerindus (all of them involved in the frauds that will be narrated in thenext section).In the deeds and transcriptions of records, the amounts do not always appear and,in some cases, only what was given as a pledge or as a form of mortgage appears.Considering the data collected in the deeds, it is not difficult to verify thepresence of financial capital with the land and the resources derived from it asa counterpart. The amounts of the loans added up resulted in an amount of R$30,974,582.22 (thirty million, nine hundred and seventy-four thousand, fivehundred and eighty-two reais and twenty-two cents) .2.2 FRAUD IN THE NATIONAL FINANCIAL SYSTEMThe crash that hit the major financial institutions in the 1980s is well known,which are very well documented in the Blog Grandes Fraudes , such asSulbrasileiro, Comind, Auxiliar, Maisonnave and Brasilinvest, which even todayhas former clients who claim to have lost their investments while the owners ofthe institutions go unpunished.In 1971, the National Commercial Investment Bank (BINC) was founded. In returnfor services rendered to the MFM military, Roberto Maisonnave received a majorityshareholding in the institution. Similarly, Maisonnave repaid Carchedi for hiscollaboration in the relationship with the MFM military by giving him a 10% stakein the new company. As of 1973, Banco Sul Brasileiro entered the partnership,eliminating Maisonnave's majority position. In return for the capital invested inBINC, Roberto and Carchedi were awarded positions on the institution's board,along with the military. Soc., with José Antonio Carchedi as one of its directors.The MFM presented, in one of its most common frauds, the following modusoperandi: they assumed the purchase of undertakings in difficulty and ofquestionable viability, incorporating, for example, several banks and bankruptreal estate projects, using resources that were raised from the money invested byits associates in their pension and retirement plans.The money was moved from company to company, and used mainly in the purchase ofreal estate, which were fraudulently appropriated. The MFM's relationship withcompanies linked to real estate speculation in the city of Porto Alegre wasintimate, involving a complex and nebulous triangulation between banks,construction companies and real estate companies. Fraud in the purchase of realestate involved bad checks, the release of funds without the necessary signaturesand loans that were never paid off. These movements escaped the supervision ofthe Central Bank of Brazil .Oliveira's book (1985) documents the corruption and embezzlement scandalsinvolving Banco Maisonnave and Montepio da Família Militar, as well as BancoSulbrasileiro, Banco Habitasul, among other companies that also underwentintervention and were liquidated. by justice in 1985. With the justification ofsaving the banks, loans with public money were made and were never paid back. Asalways, we have banks privatizing profits and socializing debt.For ten years, banks faked numbers to hide that they were broke. Balance sheetdata was scandalously rigged to cover up a bankrupt institution that had no moneyto pay its debts. In 1983, Banco Maisonnave de Investimento authorized thecancellation of the mortgages on the property and the property, which initiallybelonged to Asmuz - Construções e Incorporações, became part of Banco Maisonnavede Investimentos. Today, it appears that ownership of the property would belongto Maisonnave Companhia de Participações (successor to Banco Maisonnave deInvestimento SA and Maisonnave SA Crédito, Financiamento e Investimentos,according to registration). The registration proves the evolution of this debtover time, with Maisonnave Companhia de Participações as debtor, and as creditorsthe Economic and Social Development Bank (BNDES), the Special IndustrialFinancing Agency (FINAME),In 1987, the Maisonnave group mortgaged the property as a guarantee for a debtcontracted with the Central Bank of Brazil, in the amount of Cz$ 782,997,000.00(seven hundred and eighty-two million, nine hundred and ninety-seven thousand NewCruzados), which monetarily corrected amount to R$ 206,911,117.14 today (twohundred and six million, nine hundred and eleven thousand, one hundred andseventeen reais and fourteen cents).According to the MPF, if the Maisonnave group had paid the debt, it would nothave recorded the extinction of the mortgage by peremption. Thus, it is verylikely the case of a company that did not pay a large public debt and was notbothered by the creditor, who did not foreclose on the mortgage. Therefore, theproperty, which would belong to the Union if the mortgage had been foreclosed on,remained with the debtor, free for subdivision.In consultation with the Environmental Licensing (PREVIAL LICENSE 017974) relatedto the development project that was sought to be carried out in the area, weverified that an unfiling request was requested through the SEI 19.0.000091543-5process, to verify compliance with the conditions of the Municipal Secretariat ofthe Environment Environment (SMAM) of Opinion No. 95/2012 of the Commission forUrban Analysis and Management (CAUGE), "especially in relation to proof that thelawsuit with the determination of unavailability of the defendants' assets by theState Public Prosecutor's Office referring to the areas of Morro Santana (formerPedreira do Asmuz and surroundings)".At first, the undertaking was rejected by the Municipal Council for UrbanEnvironmental Development ( CMDUA), with the contrary arguments of severalcounselors, who in meetings stated that it was an area of ecological, historicalimportance, with proven archaeological potential, an Area of PermanentPreservation ( APP), with significant vegetation cover, water resources andcultural potential:President Cristiano Tatsch put the rapporteur's favorable opinion to a vote,which was not approved, receiving 9 (nine) favorable votes, 10 (ten) contraryvotes, and 3 (three) abstentions (Minutes 2541 of March 26, 2013).However, even with the rapporteur's vote against, the process was redistributedto another planning region, as stated:Counselor Euclésio read Article 22 of the Internal Regulations, Paragraph Seven,to indicate that the process should be assigned to a new rapporteur. He considered it fundamental that thedirectors carry out diligences to know the places analysed. Conselheiro Fernando(IAB) reported on the complaints that occurred the day before, in relation tonotes of irregularities in environmental licensing in the capital.He felt thatthe technical staff that evaluates the projects is vulnerable and that it wouldbe necessary to review the form of approvals by the Council, as a way of offeringgreater security to the councilors. He expressed his concern about the situationand suggested that the CMDUA should speak out on the matter.[...]CounselorJakubaszko (RGP 1) suggested that the entire process to be processed by the CMDUAand which did not obtain a consensual position should have more time foranalysis, taking into account the situation in the city regarding complaints andpossible irregularities.
