Since there was still no movement in the matter, as a first legalstep in the autumn - just before the end of the 6-month period - we sued theVienna Labor and Social Court for termination compensation for the earlyjustified resignation of one comrade. For a few weeks now, we have had anenforceable payment order for the termination compensation, the legal fees andthe interest. This means that LeFirin has been legally obliged - for severalweeks now - to pay the former worker this first installment.Since the boss even got in touch with our lawyer and stated that she was "readyto pay in principle", we actually expected that reason would now prevail.Especially now that the company owner, and not her choleric ex-husband, themanaging director at the time, was communicating. With this incorrigibleoptimism, we now wanted to offer the bosses an out-of-court settlement for thetotal amount, possibly even with an installment plan, since the total amount isin the 5-digit range. We have thought that with the legal obligation to have topay the first around 2500 euros, an overall solution that would ultimately beeven cheaper for CSC is now within the realm of possibility.But far from it. During a trust-building telephone call on our part at the end ofJanuary, it was only once again announced how bad our union was and how lastinglydamaging our campaign would not be. There is still no awareness that theexploitation of workers is not only not legal but also absolutely not ok. Thecompany is the victim of our union - so the tenor. The fact that the campaign wasand continues to be very successful should reflect reality. In the meantime, theshop at Währinger Straße 50 has been renamed from LeFirin to d'erin, while theownership structure has remained the same. The business people must havedestroyed the "brand" LeFirin permanently, since several former workers who areindependent of our members have reported irregularities related to ourpublications, some newspaper articles have appeared and, in addition to the AK, amunicipal council has also become active. And especially in the Turkish and Alevicommunity, the company is still an issue, since in the past young workers who donot know the Austrian legal situation and do not speak the language have beenexploited far too often. After all, our successfully sued terminationcompensation is not the first court decision against CSC for non-compliance withlabor laws, ...In any case, we should "continue to do everything through the court, anout-of-court solution, i.e. a settlement, is not in the interest of CSC/d'erin"as we were told. This approach is very surprising, since it means nothing otherthan additional high costs for the company. The legal fees, the court costs, theexecution costs, etc. are all added to this and, like the interest rate of 8.58%,are constantly increasing instead of decreasing.In this context, it seems important to us to point out that our fundamentalreluctance to involve government agencies in our affairs should not bemisunderstood as "they don't complain anyway". Apparently Gagarin thinks that wewon't sue and even publicly calls on us to go to court. In the case of CSC/d'erin, the next step we will take is the execution of the payment order incourt. Because contrary to the verbally articulated willingness to pay, the courtorder to pay has been ignored by CSC to date. In the following steps, we willthen sue for all outstanding salary components. We think this behavior is juststupid of CSC, although our law firm will appreciate it.
