Second article in the series on trans struggles: after hormone treatments last
month, let's change the register and talk about marital status. Having IDs withthe wrong first name or the wrong gender is painful at best, dangerous at worst.---- In France, until 2016, it was very difficult to change sex in the civilstatus. Among other things, it was necessary to prove to be suffering from a"transsexual syndrome" and to have undergone sterilizing treatment. The courtdemanded invasive and costly expertise[1]. The 2016 law significantly improvedthe situation. First name changes can be made at the town hall, and the change ofgender mention is simplified: both only require proof of a social transition[2].However, the latter still requires a petition to the court.Law enforcement is uneven. Some town halls reject any change of first name fortransidentity: this ends up with the prosecutor, who is often more conservativethan the registrars. If this reflex can be explained by a lack of competence, itis also often transphobia. The courts are not left out: some still demand medicalevidence or judge on appearance. Gathering evidence of a social transition can becomplicated. How to provide invoices to your new first name when many services(telephone, Internet...) require an identity document ? How to collect theessential testimonies of relatives when you have a hostile family, or when youare socially isolated ?dangerous tracksWhen the request is accepted, an ordeal begins to change its informationeverywhere: bank, administrations, diplomas... And traces remain: the full birthcertificate mentions the changes, and the acts of the children and spouses areonly modified with their consent. Along with court records, we have a tickingtime bomb waiting to fall into the wrong hands. The Attorney General of Texas hasthus compiled a list of all trans people on its territory...Internationally, many countries prevent any change of sex or still requiresterilization. The current transphobic wave is holding back progress (as inScotland[3]) or threatening serious setbacks (as in the United States[4]). Intruth, the mention of sex in the civil status has no interest and should bedeleted. This is a demand from a number of organizations, also linked to accessto PMA for all and which would take non-binary people into account.Chloe (UCL Grenoble)To validate[1]Opinion on gender identity and on the change of sex designation in civilstatus, CNCDH, July 31, 2013[2]Law for the modernization of justice in the 21st century, 18 November 2016.[3]"UK Government to block Scottish Parliament's Gender Recognition Reform over‘significant impact' on ‘GB-wide equalities'", The Scotsman, 16 January 2023.[4]See the "Anti-LGBTQ Legislative Tracking" file at https://t.co/ejYDsffNQmhttps://www.unioncommunistelibertaire.org/?Comprendre-les-transitions-de-genre-Changer-de-sexe-a-l-etat-civil_________________________________________A - I N F O S N E W S S E R V I C EBy, For, and About AnarchistsSend news reports to A-infos-en mailing listA-infos-en@ainfos.caSPREAD THE INFORMATION
