How the AWO (workers' welfare) in Dachau wanted to avoid paying wages - and
failed at the FAU... ---- Business & Society By: Patrick Lohner - May 12, 2023---- It's the end of the month that Money from the employer is in the account. Sofar, so normal. But it is always amazing how often this absolutely basic minimumstandard is lacking in Germany. Unfortunately, in its day-to-day work as a union,the FAU encounters all too often that employers dodge their wages in whole or inpart. There are hardly any limits to the imagination. The palette ranges frombrazenly ignoring the obligation to pay to unconventional interpretations of thelaw. Often, terminations are used to evade outstanding vacation or overtime workwhen the last wage is paid.A remedial teacher from the AWO Dachau was paid for a month at a lower salarylevel than is actually intended for her qualification. Shortly before she leftthe company, she drew the attention of the HR department to this, whereupon herclaim was contradicted. Unexplained deadlines have passed. When asked what thedeadlines were, she received no concrete answer. The FAU Munich then sent aletter to the AWO Dachau office to claim the salary for its member and to confirmthe claim. When the opposing party let the deadline expire, a lawsuit was filedwith the Munich Labor Court. As a result, the AWO Dachau quickly tried to reachan agreement and transferred the outstanding amount of almost 500 euros.Soon after, another colleague answered. This time, the AWO not only paid toolittle, but no wages at all to a pedagogical support worker in training as acurative education nurse. In the justification, the AWO Dachau was quitecreative. The AWO office simply assumed that our member had been ill for the samereason throughout the year during her training in an inclusive kindergarten andthat she was no longer able to continue paying wages with her sick days in thelast month of employment. The wages were simply not transferred withoutjustification. Again, the whole thing happened at the end of the employmentrelationship. The AWO Dachau does not seem to be acting randomly here, but ratherspeculating that the outstanding money will no longer be claimed by theemployees. Again, the social association had to be taught better. A lawsuit wasinitiated jointly with FAU Munich. AWO Dachau then immediately transferred theoutstanding amount of EUR 1,942.However, the AWO is not an isolated case. FAU recently faced very similarconflicts at a martial arts studio in Leipzig, at TIER in Hanover, at an icecream parlor in Bonn and at a kiosk in Aachen, and the list goes on and on.Discrepancies in payroll accounting should therefore be clarified quickly andcompetently.
