The decisions of the Constitutional Council do not surprise us and testify to the
failure of the institutions of the Fifth Republic. To obtain the withdrawal ofthe law we can only count on ourselves! ---- We have nothing to expect frombourgeois institutions. ---- By censuring only six articles of the reform,including some rare social measures for the elderly, the Constitutional Councilconfirmed its true nature: to protect the institutions of the Fifth Republic fromthe social movement. If we didn't expect much from the so-called "wise men"appointed by the President of the Republic and those close to him, this is clearproof that social transformations, even the most obvious ones, will not takeplace in salons or by believing in the virtues of the constitution of the FifthRepublic. By promulgating the law in the middle of the night, following theopinion of the Constitutional Council, Macron is adding fuel to the fire and onceagain provoking the social movement. However, this does not change anything forus: in 2006 the CPE(1) was promulgated before being withdrawn and never appliedin the face of a massive mobilization.Retirement will be achieved by struggle!Faced with the failure of this last institutional solution, after 49.3[2]and therejection of the motion of censure, it is up to us, the workers, the unemployed,the young, precarious and retired, to fight once again to preserve and extend theour social achievements. The real surprise comes from maintaining the unity ofthe large unitary inter-union which aims to organize May 1st and refuses ameeting with Macron who would not aim to discuss pension reform.For us libertarians, May 1st is an essential date to assert our class interests,and we can only rejoice that it is participated in a unified way by all the unions.However, we cannot be satisfied with this.For this day to relaunch the social movement in a victorious cycle, it must bebuilt in our places of work and study. Let's multiply the GAs[generalassemblies], strikes, blockades and all the necessary actions to maintainradicalism and combativeness, to culminate in a May 1st of historic struggle! The provision, after being promulgated, was withdrawn after a long periodof struggles and disputes.2) The French Government has placed the trust within the terms set out in the article49.3 of the 1958 Constitution. This article, then inserted in the text and thenmodified later in a restrictive sense, has the function of protecting so-calledminority governments, i.e. relative majority governments, which have otherminorities against them which normally would not be combined among them. TheGovernment puts trust because if you voted only on the text, without trust, youwould count the yeses and nos: the opposition groups could easily add up, eachwith their own separate motivations, and the executive could lose. On the otherhand, the Government, placing the trust, causes the text to either pass without avote (if the oppositions do not react) or if they present motions of noconfidence as a reaction to the trust, the method changes by raising the step: amotion of no confidence voted together must reach half plus one of thecomponents. It is a logic analogous to constructive distrust: the opponents havethe burden of proof of demonstrating that the majority is actually a minority,but to do so from a quantitative point of view they have the obligation to arriveat half plus one and from the point of qualitatively they are obliged, as itwere, to get their hands dirty by voting together with political opponents whoare positioned on the other extreme. In this case, Macron's opponents seemcapable of overcoming the second problem with a so-called 'Sicilian' ploy: LePen's far right and Nupes' left would vote together for the text of a centristgroup. I say 'Sicilian' because it brings to mind the experiment of the GiuntaMilazzo in Sicily in 1958, when both the PCI and the MSI gave their consents to acentrist exponent who broke with the DC. However, at the moment they do not seemable to overcome the quantitative one by reaching an absolute majority becausethey need various votes also from the center-right Republicans, who at the momentdo not seem to be in sufficient numbers to pass the step. Contrary to what manymay think, even if included in the 1958 Constitution, this instrument was notinvented by De Gaulle or some Gaullist exponent, but by the French DC deputyMoisan in 1953 as a punctual amendment to the Constitution of the Fourth Republic(actually inspired by his party colleague Fernand Chaussebourg) in whichgovernments that remained with a relative majority resigned because they wereunable to govern. A proposal then modified in a more punctual way by another DC,Paul Coste-Floret in 1957, again as an amendment to the Fourth, and from therepassed into the new text.
