This January 25, the Constitutional Council censored 32 of the 86

extremely dangerous to believe that such a "legal shield" could
sustainably contain the rising nationalist fury. Popular mobilization is
our bulwark, not the Constitution. ---- This is all political
maneuvering. It must be remembered that the president himself,
overwhelmed by his right, had seized the Constitutional Council as a
last resort, in order to clear himself of having passed one of the worst
laws in decades in terms of repression and racism. The Constitutional
Council therefore played the role of safeguard by removing the worst
from the law, but nothing is finished. The reasons for censorship by the
Council are based on form and not on substance. They are not rejected as
not being in conformity with the Constitution and nothing would prevent
these same hideously racist measures from being taken up in another text
of law.

Among the remaining racist measures:
- forfeiture of nationality for French dual nationals guilty of murder
of a person holding public authority;
- non-issuance or non-renewal of the residence permit in the event of
"non-compliance with the principles of the republic";
- the end of collegiality of asylum application judgments;
- the exclusion of children of foreign origin from social assistance for
children (ASE) subject to an OQTF when they reach the age of majority.

This law, in its different versions, marks a certain turning point, of
fascistization of our society, of a president ready to inscribe national
preference and the loss of nationality by allying with the RN, of a
radicalization of the government towards The extreme right and a filthy
racism that spills onto TV sets, to talk about "couscous anti-Semitism",
the way high school girls should dress, or even the justification of
deaths at the hands of the police.

The impunity of the police officer responsible for the rape of Théo adds
to the spectacle. Faced with this, political mobilization will not have
brought as many people as the seriousness of this law would imply.

However, it is crucial not to settle into the demobilizing idea that the
Constitutional Council is a "safety net" which will always be there to
block the authoritarian drift of a future nationalist government. A
constitutional framework can be broken; part of the police and the army,
whose putschist inclinations are known, ask only for this.

Popular, united, massive mobilization is the best defense to dissuade them.
