At the end of February, almost eleven years after the events, the Court
of Appeal of Turin issued the second-degree ruling regarding thedemonstrations of April 2014 against the Third Valico high-speed
construction sites. The verdict also saw the conviction of two comrades
from the Perlanera Anarchist Laboratory of Alessandria, who for now have
access to probation. ---- The Third Valico is the high-speed railway
project on the stretch from Genoa to Tortona, a relatively short route
that does not involve, among other things, a substantial reduction in
travel time, but which is very useful for the movement of goods by the
transport companies of the Gavio group, the main beneficiary of this
very expensive, useless and harmful project that the local population
has immediately and decisively opposed.
In recent years, the opposition struggles to the Third Valico, which
have been struggles with broad popular participation, have developed in
various phases. First there was the mobilization against the
expropriation of the land, with actions to obstruct access to the land
carried out by the population together with the owners. Subsequently,
once the work began, the actions, always commonly carried out, were
aimed at obstructing the work, with protests in which fences were
removed and construction sites occupied for one or two days. This second
phase triggered complaints which were followed, for some, by trials and
related convictions.
The contested facts date back to 2014 and concern different episodes
even if then, at a judicial level, two of the three trials started were
merged.
A first legal action was in fact triggered for the demolition, in the
"Cascina Romanelotta" area, of 300 meters of simple plastic fences of
the Cociv construction site, the company in charge of the work, which
was also convicted for infiltration with organized crime. This trial was
then merged with the one for the protests of Pozzo Radimero, in the
municipality of Arquata Scrivia, in April 2014. On that occasion there
was a very popular march, the protesters arrived in front of the
construction site and tore down the fences. The reaction of the police
was violent and widespread, so much so that several people, hit by
truncheons, were injured and had to go to the emergency room. Despite
this, complaints were filed for resistance, which led to a nine-month
sentence and a hefty fine for a comrade from Perla Nera.
A further trial was instead set up on the basis of the crime of damage.
In reality, it involved graffiti written on some bulldozers, on a sign
and on the wall of a shack, during another invasion of a construction
site, again near Arquata. In this case too, a comrade from Perla Nera
was convicted.
From a judicial point of view, the reasons for the sentences are
awaited, which should be released at the end of April; consequently the
lawyers will evaluate if and how the statute of limitations can act,
given the temporal distance from the facts, and how to proceed with the
appeal to the Supreme Court.
For the rest, we cannot but note, once again, how the repression,
subservient to the interests of exploitation of the territory and the
profits of large industrial groups, is furiously trying to weaken what
is a protest against a useless and harmful work. A protest that, we want
to underline once again, was not an avant-garde choice, but marked a
high point of popular participation, a full sharing not only of
criticisms, but also of practices, those practices of direct action that
power is truly afraid of.
