In Latin America, the feminist and queer movement has been able to put
forward the debate for free, safe, and legal abortion. In 1990,September 28th was established as a symbolic day of struggle for the
legalization and decriminalization of abortion by the Fifth Feminist
Encuentro of Latin America and the Caribbean. Since then, and until
today, the feminist movement has won victories in every one of the
countries in the region and has left a mark on the public agenda.
The reality is distinct in every region of the continent, starting with
the situations in Chile and Brazil, where voluntary abortions are
prohibited and penalized. Although some exceptions exist in Brazil,
access to the procedure through legal routes is always difficult. The
cases are somewhat different in Uruguay and Argentina, where in 2012 and
2020, respectively, where street mobilizations forced legislative
concessions that allowed women to make decisions about their own bodies.
The Colombian case is also significant, as free and legal abortion was
secured in 2022, with even less restrictions.
The United States deserves its own paragraph. The right to a voluntary
abortion had been guaranteed since 1973 through a group of amendments.
However, in 2022, the Supreme Court reversed the decision and granted
each state the ability to adopt its own legislation on the issue. This
created a huge disparity in the access to abortion across the country.
The illegality of abortive practices, far from avoiding abortions, has
only put our lives at risk. It is important to note that this practice
cuts across lines of gender, race, and class. Historically, these
matters have pushed poor women, Black women, and gender non-conforming
folks into deadly situations- meanwhile, those women who could afford to
pay for an abortion had access to safe private clinics.
In moments where the reactionary discourses grow all over Latin America,
it is urgent to fight for the autonomy for women and gender
non-conforming folks. Because of this, the struggle for free, safe, and
legal abortion is not different from the struggle for the right to
decide over our own bodies. This goes hand in hand with the struggle for
comprehensive sexual education and to guarantee access to birth control.
Both are necessary pillars so that we can exercise family planning, and
we can freely decide about our lives.
If we learn anything from the feminist and queer movement, it is that
the struggle must not be interrupted, only strengthened. The dominant
sectors will always try to control our bodies and limit our autonomy,
which puts us on constant alert to maintain the rights that we have won
through struggle and organization.
That's why this September 28th, we say:
Comprehensive Sexual Education to decide!
Birth Control to not abort!
Free, Safe, and Legal Abortion to not die!
