The Proposed Constitutional Amendment number 215 (PEC 215) application filed from the year 2000, is a frank and direct advancement of conservative forces against the rights of indigenous peoples (indigenous). The basis of its operation, should it be approved, rests on the following items. ---- Begins starting with the change of the grantor, changing the competence of the demarcation of land recognized by the Constitution of 1988 as part of the ancestral right of the first inhabitants of Brazil. Thus, the executive branch would no longer be responsible for this task of marking the passing (or not) the lands of the original nations to Congress. ---- Two other tasks also would the Federal Legislative Branch. An alternative form of regulation of these territories. Today demarcation is approved by decree and with PEC 215, would be as law. Thus, the National Indian Foundation (FUNAI) as a specialized agency on the issue, propose less indigenous policies, getting the tutelage of Congress. Over 25 years have passed and now the victorious agricultural large-scale model aimed at the export advances over the first Brazilians. The rights of indigenous peoples and Maroons transcend its own existence. If the country does not recognize it, is because in the real world, is in favor of a predatory culture of limited natural resources and makes the praise of pioneers and their descendants. If Brazil makes every effort in recognition of this right and the consequent execution, will give a wide and safe passage to review the story itself and condemn the genocide and indigenous African slavery in all its dimensions.
