In view of the constantly declining social situation of students in Europe and around the
world, some student unions are defending financial echanisms that allow students to follow
their training rather than work hard to survive. ---- Since its announcement in November
2018, the increase in registration fees at the University of France, for students who do
not come from the European Union, has sparked strong debates, both on television and
television. in the general assemblies within the different facs. ---- These exchanges were
only a repetition of an old antagonism between two conceptions of higher education. The
first, the one that sees them as an investment, justifies the idea that you have to buy
"skills" to get a better salary when you actually get to work. It is therefore normal that
tuition fees are high and that the student goes into debt to finance his studies.
The second conception considers higher education as a right. This is to ensure that every
person has the opportunity to go to the University if they wish, and then to ensure that
they can study in the best possible conditions. It follows logically from the demands like
the free studies or the setting up of financial mechanisms allowing the students to
concentrate on their formation without having to work in parallel. The student salary,
which is defended in France by Solidaires étudiant.es, is the most radical form of this
kind of mechanism.
This claim aims to provide a salary to each student, taking effect from the end of
compulsory schooling, and allowing them to continue their training in complete autonomy,
without parental, state or private guardianship. Since training is not a passive
investment in the future, but a positive contribution to social production, it is a
question of paying it.
Listening to initiatives
If Solidaires étudiant.es is the spearhead in France, it is in the framework of the
discussions started recently, that the three major student unions of the European Network
of Alternative and Basic Trade Unions - Resab [1]made a joint call [2], inviting all
organizations and collectives interested in this claim to discuss it, in the framework of
a European assembly.
A response, unifying all workers in training on a combative basis, is becoming more and
more necessary. Not only to protect acquired rights, but to conquer others, and to break
the logics of precariousness and social reproduction that reign in training.
This international appeal is an encouraging sign for all those who consider that student
unionism should not confine its action to daily struggles, but that it must also set
itself ambitious goals of social transformation. Whatever our opinion on this idea of
student salary, we must therefore listen to any initiative of this type.

From the beginning of its activity at the workplace, the Workers' Initiative was
struggling with legal obstacles. The trade union as a formal structure is subject to
specific legal regimes, without which it is not possible to associate employees to defend
their rights and professional and social interests. Trade unions and trade unionists can
not allow to undermine the effectiveness of their actions, which would most often be
severe sanctions on the part of employers who are always always in a better position in
the dispute with employees. ---- The scale of responsibility that stands behind the
persons supervising the work of the association is so great that we have met with
resignation from membership for this reason, and consequently also with further efforts
for better working conditions. Fears of potential mistakes are not unreasonable: labor law
is a legal branch that also raises problems for qualified lawyers.
With time, some people related to the environment of the Employee Initiative, seeing the
urgent need to participate in a trade union of someone with legal competence, decided to
become educated in this direction. This decision quickly turned out to be a hit, because
even during the studies of these people it was possible to set up a group for the Aid of
the Association, which is used by the union's committees every day, and the cases of
individual employees whose rights were violated. What is particularly interesting is that
one of the important factors that allows winning the majority of cases is the closeness of
the group members to the committees. Working on a day-to-day basis to implement the
commission's demands, lawyers understand much better the specificity of a given plant than
an outsider. Apart from the legal group, activists also participated in representing
members of the association. Very often, they were able to present a lot of substantive
arguments before the court, but they complained about procedural aspects that would be to
their detriment. Therefore, it was necessary to establish a legal group.
Relationship service
The dominant group activity is legal assistance in the field of current presence at the
workplace. When setting up a commission, representing your members, correspondence with
the employer, giving opinions and agreeing work and pay regulations, controlling health
and safety rules, social labor inspectorates, etc. - employees are often unable to look
after their own procedures without checking which their employer can question their
movements . What's more, in large enterprises where every day the employer has access to
his lawyers used to run a business, employees are told that they should not discuss some
of the rules. In fact, if employees do not oppose such a narrative, it will mean to them
less beneficial solutions than those
Using the support of professional lawyers, employers sometimes construct individual
provisions regarding employees in such a way that the crew has the impression of improving
working conditions, but in reality these agreements are packed with numerous picks to be
used by employers at their convenience. That is why the physical presence of trade union
representatives during negotiations is so important. Thanks to this, they can quickly
assess what will actually mean for employees the provisions of individual agreements. By
participating in the editing of letters to employers, taking the floor in disputes - the
relationship gives a signal that not only the narrow representation of the crew is
involved in conflicts, but also an extensive structure that has at its disposal a wide
range of employee rights enforcement tools.
In parallel to activities undertaken directly by the members of the group, they try to
instruct trade unionists how to deal with formal matters independently, which gives them
more confidence in independent decisions on the plants, and also allows better prediction
of future movements.
An important issue, as it turned out for the commission, is the presence of lawyers in
their daily functioning. The Employee Initiative had to use the services of external
lawyers not once in its history, which very often led to the fact that without knowing the
specifics of a given workplace, they advised solutions that were less satisfactory for
employees.
Handling cases before a court
Another important area of legal assistance in which the group is involved is
representation of the union and its individual members before the courts. Due to the fact
that so far none of the participants in the legal group is a professional lawyer (legal
advisor, advocate), union lawyers receive power of attorney on the basis of a civil
procedure allowing a trade union representative. Although the cases before labor courts
are the vast majority of the processes in which the Employee Initiative is listed, there
is no doubt that there is a need to attend union lawyers also in criminal and
administrative proceedings. This need can be seen especially in the moments when the union
directs the prosecutor's office to notifications about crimes against the rights of people
who are engaged in gainful employment or obstructing union activities.
At present, 18 proceedings are under way, 15 of which are in the area of the Poznan, 2
Warsaw and 1 Wroclaw appeals. The group's activity is focused on Greater Poland due to the
fact that all its people live in Poznan. Over the years of activity there was and still is
a demand among committees from other parts of Poland to address their problems to the
courts, which was, to some extent, implemented. Unfortunately, sometimes due to the
distances between the group members and individual crews, the group can not guarantee
legal assistance to the same extent as in Wielkopolska (which also applies to the service
of the union). The demand for legal aid increases with the increasing number of union
members. At this moment, we are observing a sharp increase in the number of the Employee
Initiative.
In the courts, there are, among other things, issues regarding: determining the number of
trade union members, evading penalties for procedural liability, termination of employment
contract, severance pay and compensation. In many of these cases, employees would never go
to court alone. Employers, being aware of this, allow themselves to be exempted for
earning 99.68% of the norm or absences during illness. This is unfortunately a mass
phenomenon. Employees are afraid that the language and complicated legal procedures will
overwhelm them and expose them to additional costs, and the employer with the use of
professional lawyers will do so anyway. The real face of the Polish justice system
confirms that their fears are justified, which is even more plunging the needy.
So far, 21 cases have been won in the trials in which representatives of the trade union
took part. 12 have been concluded with a settlement, but this should also be treated as a
kind of victory, because employers were aware that the courts would be right to trade
unionists, and that reconciliation would allow a faster settlement of the dispute. 11
proceedings have been lost, but this also shows that the Workers' Initiative, despite the
difficult facts, does not leave its members alone and fights for favorable rulings for
employees until the end.
All issues raised during the processes are after their completion properly described and
published in the Employee Initiative Bulletin and on the website of the association. In
these descriptions, the members of the group refer not only to the legal issues, but also
to the broader context of individual workplaces, so that the rest of the union can also
use the contents of the judgments. On the occasion of disputes before courts, benefits for
employees are not only verdicts. An example of this may be the case brought against
Amazon, in which an established health and safety expert drew up an extensive opinion in
which he showed that "Working in the Amazon is not adapted to the physical and
psychological abilities of a person and an employee". On the basis of this opinion, the
Amazon factory committee did not only conduct its media coverage,
Needs for the future
As it was already discussed above - the relationship needs people with a legal flair. In
particular, support from lawyers from towns other than Poznan would certainly be a factor
that would increase the dynamics of activities at workplaces. At this point, the group can
not ignore the momentous problems of committees from other regions and help them, which
involves time that should have been locally developed. 2 people serve and represent
members of over 60 active commissions from 27 localities in court. In addition to the
intensification of existing activities, the group also aspires to write its own magazine
and open the student platform. Especially for this group, the option of engaging in a
trade union should be attractive, because only this way, future lawyers can practice
appearing in court.

If you needed further convincing that our mainstream and even fringe political parties
have only their own interests at heart, then join us as we take a look at the aimless mess
that is the upcoming European Elections. ---- The Big Two ---- A divided Labour Party
continues to struggle with internal battles between "democratic socialist" Corbynites and
business friendly vaguely left leaning liberals. Both sides use Brexit, not as a way to
try and help the voters they represent, but rather as a chance to weaken their internal
opposition. ---- Local elections saw support for Labour fall as identity problems continue
to confuse potential supporters of "a party with socialists in it". ---- The Conservatives
handling of Brexit has been seized upon by opportunists within the Party. Power struggles
emerge between different strands of Toryism, from shiny polished neo-liberal politicians
to those trying to play the populist card or "one nation" Tories. Needless to say that, by
acting on remainers' fears about the economic impact of Brexit, or adding fuel to the fire
of those worried about immigration, Tory MP's seek only to further their own careers and
maybe get that bigger second home! Because whatever the degree of hatefulness they present
to the public it will not affect them in the slightest, they will continue to live
separate lives with big salaries, private health care and private education.
The divides in our biggest political parties highlight that those motivated by power can
never truly represent us. They will always be lead by a desire to hold on to what they
have or a chance to grab more.
What about an alternative then? From the hydra of hatred Nigel Farage and his newly
spawned Brexit Party? Or UKIP, who have tried to plug the gap left by Farage's resignation
with members of the alt-right, rape apologists and islamophobes? The truth is that even
with the degree of success these parties have had, (and look to achieve again with The
Brexit Party presently polling highest) putting openly or more closeted racists into the
European parliament to try and ensure a HARD Brexit will yield little success. After all,
the European Parliament has been laughing at Farage since 2014 when he was first elected
to Brussels.
But even if these problems could be resolved, elections cannot solve the problems our
society faces. By handing over responsibility to power hungry politicians, we continue
this real life Game of Thrones and only offer encouragement to those that feel like they
deserve to rule over us. Our political system is doing exactly what it is meant to do;
serve the interests of the powerful.
So what is the alternative?
The Anarchist Communist Group understands that many people vote in the hope of making a
difference, with the word change used like currency from all sides of the political
debate. This desire to make a difference, were it channelled into organising in our
workplaces and communities at a local and national level, could see the beginning of a
society built not for profit and power but of solidarity and mutual aid. The Anarchist
Communist Group calls on the working class not to strengthen the grip of the power hungry,
bosses, land owners and aristocrats, but to find ways to make it harder for them, to build
resistance and fight to defend what we little we have, while working to build the world
that we want.

Burn the European elections on Thursday 23rd of May in the Noorderpark. ---- We didn't
know what to do with them otherwise, best use them to start a barbecue! It promises to be
a very gezellig afternoon with a barbecue, some drinks, a little music. Would you like to
come by? Please bring you voting pass, identification is not neccesary! ---- Why burn your
voting pass? ---- To end the hope a lot of us feel to achieve a broad left movement, or
‘honest leftist politics' once and for all. Some of us feel guilty when they don't vote.
You should instead feel guilty when you do go out to vote! Leftist parties have insulted
workers, students and their own integrity time and time again. They're not any better than
their right wing rivals, even more so: they continue to squander the name of leftist
politics by promising social reforms but instead voting the same as their capitalist
counterpart.
The effect? People associate leftism with austerity, discrimination and war. The weak
social democrats in The Hague give all leftis organisations, anarchist, trotskyites and
the like a bad name. If we don't take a stand against this publicly, we will never rise
above them. Because that is our end game, to be able to shape the world together, without
having to ask permission from a bunch of capitalists with a red pin attached to their jacket.
So, come by the burning on the 23rd of May in the Noorderpark. We will be located in the
field of grass next to the entrance to the park close to Café ‘Het Boemeltje'. We will be
there from 17:00,come by whenever you want. The beer will be cold and the barbecue will be
smoldering with all our combined voting passes.

The party that has rigorously championed the cause of the rich, powerful and ignorantly
fearful has won. Most disappointingly, the lack of effective counter arguments from the
so-called ‘opposition' have left a void the Liberal Party has gladly filled. We're not
convinced that the working class are sadomasochistic or stupid, so why has all this come
about? ---- As Anarchists, the idea that our participation in shaping society should begin
and end with a ballot box once every while is laughable, even when election time does
sometimes come with a sausage sizzle. We have grander visions for a more engaged and
directly democratic society that is fundamentally incompatible with capitalist
governments. We have a vision for a society based on freely associating communities that
govern their own interests and federate with other communities to make large scale
decisions - A classless and egalitarian society based on human need and not profit.
Without demonstrating this political motif in communities of need, and without enlisting
people actively in our vision, can we rightfully be shocked that more working class people
are buying into right-wing narratives, centered around xenophobia, fear and trickle-down
economics?
If we want to make any kind of meaningful change to society, then our mission has to be to
build social movements that are capable of forcing that change, regardless of which party
is in power. It won't be easy and it won't happen overnight but it needs to happen. There
are deadlines for this project, and we know the Liberal Party are too deep in the pockets
of the coal magnates to act in the interests of the planet. This election may make the job
more difficult but the job remains the same.
Leftists and activists have reacted with shame, disbelief, despair and anger at the result
of the Liberal Party election win. These reactions show that the racism embedded in this
country is somehow a surprise to people or a deviation from the norm as opposed to being
founding principles of the Australian state's colonial project.
Jokes about moving to New Zealand miss the point completely, especially from those on the
radical left. For those of us who are settlers, it is our responsibility to dismantle,
organise against and deal with The colonial-capitalist project that is Australia rather
than buggering off and leaving First Nations Peoples in the dust. These reactions are
neither helpful nor do they get to the root of why this election happened or how we should
organise in its wake.
What shouldn't be surprising about this election is that most of Australia don't see class
or social equality the same way that we do. If we are going to build movements that are
capable of changing anything at all we need to recognise that. Without detracting from the
ability for oppressed groups to analysis, dissect and challenge their oppression, our work
lies in having difficult conversations with people about the issues that affect their
lives. We need to stand and act in solidarity with people targeted by a new and
re-invigorated wave of Liberal attacks on workers, women, gender diverse people, the
disabled, migrants and the poor. That requires organisation.
As Anarchists, we need to have thought-out alternatives to the profit-driven capitalist
society we find ourselves in. If we are against profit as the fundamental driving force of
decisions in society, then we must offer some kind of plan for a society based on human-need.
If authority and power in the hands of disconnected rich, white men acting in their own
interests don't answer the problems facing communities of colour, indigenous, queer,
gender-diverse and working poor communities, then we must have a plan for how power might
be placed in the hands of communities and groups of people to govern their own interests.
If we believe the state is a counter-intuitive way to achieve a classless society without
oppressive institutions, we must be ready with ideas to pose about how we might reorganise
this society without a state. How communities might make economic and social decisions.
If we are for an international revolution where all oppressed people lead their own
emancipation, then we must think seriously about how our organisational tendencies make
that a possibility.
There are Anarchists that don't like voting, that vote only on consensus, that work only
in small affinity groups. Any organisations, campaigns and efforts we take part in must
prefigure the structures, principles and ideas that would make it possible to run
large-scale Anarchist operations and communities, enough to avert impending climate
crisis, rising homelessness and further land-grabs by the colonial state. These
communities and operations will have to involve as many people as we'd need to undo the
harms done by the attacks of those in power; of colonialism, patriarchy and capitalism.
This requires organisation, structure, decision-making, coordination and action.
All of our efforts and strategies must be consistent with how an eventual Anarchist
society might actually be operated. Through this practice in our outward-facing work, we
show people that a world without leaders is possible and thus show the merit of our ideas
in action. If we don't organise to demonstrate and involve people in another possible
world, they cannot be blamed for choosing the one presented to them time and time again.
We should be able to offer a vision to people of how an Anarchist society might be better
than what we've got now. If all we can do is negate the world we live in without
suggesting and building an alternative, we leave communities with no avenue for change but
the charade that is the parliamentary process.
Too often Anarchists are the gatekeepers of Anarchism. Anarchism, if it is to be
successful, can't belong to a subculture of people, to a clique. It must belong to all
people; to shape it, to implement it, to make it better, more relevant and more effective.
If we are committed to gatekeeping Anarchism and not finding ways to bring it to people
then we will fail. If we are committed to being underground cells so concerned with our
security that we disappear into obscurity, we will fail. As well as actions that might
require security and trusted relationship, there should be beginner, public-facing events
that bring new people in. This requires discussion and coordination that we don't often
see among Anarchists in Australia - Long-standing projects of Anarchists to discuss,
dissect and disseminate Anarchist ideas to more people and to demonstrate the
possibilities of communities and groups organising for human-need in a world bent around
profit. This isn't a call for people to join our organisation, but for people to organise
together in some capacity.
Building the institutions, services, campaigns and initiatives necessary to sway people to
the cause of human-need and not profit, requires meetings and a documented political
memory. It requires making mistakes. It requires space to learn and revise strategy. It
requires trust built with people who work together over long periods of time. It requires
voting on decisions. It requires agreeing on strategy and tactics. It requires discipline
and perseverance. If we don't do this, we will fail.
Rather than lamenting this election, let it be a call to action. No one that has been in
the crosshairs of our government will have any doubts that the Liberals, emboldened by
this win, will strike harder. The question is, what are we going to do about it?

On April 9, 2019, the District Court for Warsaw Sródmiescie decided to discontinue the
criminal proceedings against Jakub Zaczek, an activist of the Polish Syndicalists' Union,
from the private prosecution of Poczta Polska SA ---- Accusation accused Zaczek that "from
June 2016 to the present day, through the means of mass communication, ie the Internet, as
well as during organized gatherings, he talked to Poczta Polska SA about properties or
proceedings that could humiliate it in the public and expose them to loss of trust
necessary for a given type of activity by posting offensive or untrue comments and
information about Poczta Polska SA on the Internet network, as well as publicly repeating
them during organized gatherings, ie an act from Article 212 of the Penal Code. "
In the justification of the prosecution, Poczta Polska SA added, among others:
"Apart from the risk of lowering the reputation of Poczta Polska SA in the assessment of
potential clients or business contractors, there is a real risk of personnel paralysis,
which would most likely result in a deterioration of the ability to perform tasks for the
defense of the Polish State."
The District Court found this argument unconvincing.
The court stated that "the private prosecution submitted obviously has no real grounds for
the accused, and the statements against him do not fulfill the signs of the act under
Article 212 of the Penal Code." In its justification, the Court further stated:
"The accused has the accused, claiming in his defense that the private prosecutor has not
provided any proof that the author of the quotes quoted on page 3 is accused.[...]In
essence, it is not known whether the accused is directly accused of other people's
statements or participation in the collective "propagation" of quoted slogans, due to
being one of the representatives of the Polish Syndicalists' Union, which "uses to
dissatisfy anarchist activity not only current employees of Poczta Polska SA but also
former employees."
One could guess in this situation that the accusations quoted in the justification of the
act were made by the accused during the organized gatherings. Again, however, they do not
confirm this, and even deny the materials attached to the indictment.[...]The congregation
was shouting "Management for 1500 PLN", "Enough exploitation", "Management for shovels".
The speakers apologized to the clients for the poor quality of the service justified by
insufficient number of employees. The syndicalists also took the floor criticizing the
current system of power in Poland.
In this situation, according to the Court, it is obvious that there is no real basis for
the indictment, which accuses Jakub Zaczek of a mixture of the statements of another
person (postman) and quotes of unknown origin. The offense referred to in art. 212 of the
Penal Code does not provide for a collective responsibility regime, and even an active
participation in an organization that "propagates" passwords that are unfavorable to an
aggrieved company is not a prohibited act unless it is possible to attribute specific
behavior to a specific person.
In addition, it should be pointed out that the quoted statements, although critical to the
aggrieved company, and especially its management board, however, according to the Court,
fall within the limits of allowed criticism and constitutionally guaranteed freedom of
expression. The prosecutor, citing the complaint regarding his specific public tasks and
the resulting monopoly on postal services should in this situation be ready to criticize
his actions, especially in the area of caring for decent working conditions and pay for
employees. In this situation, the statements of postmen and people from the organization
supporting them, which is allowed criticism, undertaken in the public interest, within the
individual's right to freedom of expression, in the court's opinion do not fulfill the
features of crime.
As a side note, quotes quoted in the complaint are criticisms of the company's management
and people managing trade unions, and therefore it is natural persons - insofar as they
feel offended by these remarks - should bring prosecution at their own expense. "
Previously, Poczta Polska has already tried to accuse Jakub Zaczek of "provocation to
commit a crime" in connection with art. 212 of the Penal Code, however, the District
Prosecutor's Office, by a decision of 13 July 2017, discontinued the proceedings in the
absence of a public interest in continuing prosecution from office.
