birth of the Meloni government, between September and October 2022, the liberal
galaxy - which pontificates in the newspaper Il Foglio, plays on the TV channel
La 7 and builds consensus on the Il Post website - theorized that "but as a
return of fascism, these they will have their hands tied in the economic sphere
by the constraints of the European Union and at most they will make up for civil
rights, removing something there just to make a fierce face and give a signal to
their own that they are the same as always". Although apparently plausible, the
thesis did not reckon with the desire for revenge of an enormously resentful
right, obsessed with Gramscian hegemony, eager to rebuild its place in the sun
and ready to impose a vision that rhymes with nation. In the most common
definition, the term nation means a group of people who share historical
traditions, language, culture and origin. It is a concept that the Italian right
has been repeating continuously since it has been in government - Meloni alone
expressed it about fifteen times in her inaugural speech in the Chambers - and
which however obviously rests on fragile foundations. Italy seen from the right
is a mass of ethnic groups, multiple identities, latent but pulsating class
conflicts. This is why we need to compact the nation and exclude everything that
is not common and compliant. This is the purpose of the rain of crimes that for
almost a year has soaked the penal codes and the lives of so many. The first to
be affected, for those who remember, were the rave parties: whoever organizes and
promotes a rave now risks from three to six years in prison and a fine of between
one thousand and ten thousand euros, based on the new article 633-bis of the
Penal Code. Following the Cutro tragedy, in which 95 people died trying to land
on the Calabrian coast, the government introduced a new offence, pompously called
"death or injury as a result of crimes involving illegal immigration", with
penalties from 10 to 30 years in prison. An invented crime which, according to
all the experts, has no effect on migratory flows and which, however, serves
precisely to perpetuate the logic of divide and rule: the bad guys are the
smugglers, the good guys are us who identify them as such with the help of the
penal code. Then there is the proposal of the League, approved by the council of
ministers in mid-April, which provides for "sanctioning provisions on the
destruction, dispersion, deterioration, disfigurement, soiling and illicit use of
cultural or landscape assets": it is the ad hoc crime sewn this on the skin of
the activists of the latest generation, the environmental movement that has made
itself more noticeable in the last year with the protest actions directed, in
fact, towards some of the most famous Italian places in the world (the charcoal
dispersed in the water from the Fontana della Barcaccia, in Rome, and the colored
paint on the facade of Palazzo Vecchio, in Florence, the most sensational).
Defined by the government majority itself as "the bill against eco-vandals", it
is of little use to point out that the crime of soiling already exists and also
includes the aggravating circumstance: the text, in fact, aims not only to
repress and curb dissent but, above all, it serves to create a rift, to alienate
possible sympathies towards the cause brought forward by Ultima Generazione.
Without considering the other possible crimes that the parliamentary majority
intends to introduce: from the crime of "instigating anorexia" to the crime of
"nautical homicide", from the crime of "unlawful occupation of a private home or
residence" to the crime of "surrogacy ". Hypotheses of crime so far not
contemplated in the penal code: in the first two cases they obviously serve to
convey the idea that something is being done to combat two particularly odious
phenomena, but always with the ax of repression and never with the tool of
prevention; the other two cases, on the other hand, once again serve to impose
the legal noose respectively on a social conflict (the housing issue) and on the
absence of a right (for those who cannot have children).
