In recent weeks, the four comrades under restrictive house arrest since8 August for the Scripta Scelera operation were notified of the decreewhich sets the immediate judgment and consequently the start of thetrial at the Massa court, before the single judge, the next January 9,2024. A total of ten anarchists are involved in the investigation: inaddition to the four under house arrest, there are five comrades underthe obligation to remain at home with return at night (one of these iscurrently also under the obligation to sign) and a comrade underinvestigation who is at large . For all of them Federico Manotti, PM ofthe Genoa prosecutor's office, had requested arrest in prison forsubversive association with the aim of terrorism, incitement to commitcrimes with the aggravating circumstance of the aim of terrorism,clandestine press, as well as for only some also offense against honorand prestige of the president of the republic - crimes that wereallegedly committed with the editing and distribution of theinternationalist anarchist fortnightly "Bezmotivny". The request forimmediate trial concerns only the charges of incitement to aggravatedcrime and offense to the honor and prestige of the President of theRepublic.We remind you that the immediate trial is a special procedurecharacterized by the absence of a preliminary hearing: in fact, itpasses from the preliminary investigations to the trial hearing. Thisprocedure can only be implemented if the Prosecutor and the GIP, whomust validate the request, believe they have overwhelming evidence ofthe suspect's guilt and that he is in a state of detention (in prison orunder house arrest).In the recent past, the Rome prosecutor's office had the arrogance toproceed with this formula as part of the Bialystok operation, but thisdid not bring great luck to the inquisitors. Lately, the trial ofcomrade Marco Marino, known as Zac, has also been taking place withimmediate judgment.However, it is the first time, as far as we can remember, that in thecontext of an anti-anarchist investigation the immediate judgment istriggered only for a part of the suspects, breaking the investigationinto several strands. This is a clear attempt to undermine solidarityand above all to quickly liquidate part of the proceedings with aprecedent that can be used in the future to silence the anarchist press.Overall the operation seems rather botched. The hearing for theimmediate judgment has been scheduled while the one in cassation onprecautionary measures has not yet taken place (which will also concernthe associative accusation), with an unusual destination (the singlejudge of a peripheral court) which could be declared incompatible duringthe hearing. On the other hand, a part of those under investigation forthe editorial staff of the anarchist fortnightly will presumably betried only later, as they will not be able to intervene when issues thatundoubtedly concern them will be discussed (above all the theoreticalprofile of the newspaper), ending up being tried with a previous rulingalready issued on the subject.
