On November 15, Bakary, a FRIBIN worker in Binéfar, was fired foralleged non-compliance with the hours/time flexibility pool. Bakary hadnever refused to do any time. What this worker had done, on severaloccasions very close to his dismissal, was to make use, or attempt tomake use of, his right to family conciliation. ---- The last time heasked the company for permission to miss work, using the paid leave ofup to 4 days a year1 that all workers have for this type of situation,the company he denied it. His one-year-old son had been sick for severaldays and, after going to the emergency room for the second time, theytold him that he had to take him to the pediatrician, a situation thathe reported to the company. The only answer he received was: herepermits have always been granted based on production and there is a lotof work, the pediatrician changes during the day and if your child dies,you go out and bury him.Bakary reported this refusal to the Huesca Labor Inspection on November9 and notified the company. For the next six days, his managers did notspeak to him until, finally, he was fired with a dismissal letterriddled with falsehoods. From CNT Huesca, regarding what happened, westate the following:Family conciliation is a right that all workers have and that manycompanies violate, illegally, in an attempt to prevent workers frommissing even a single day of work, even if it is for a justified reasonsuch as going to work. little son to the pediatrician. Discriminationdue to the exercise of family conciliation rights is completely prohibited2.Reporting and suing the company is also a right of workers. Theprohibition of being retaliated against for going to the LaborInspection or the courts to legally defend your rights is aconstitutional right3.Dismissing a worker with a false cause for exercising his/her right tofamily conciliation and for denouncing his/her company to the LaborInspection is completely illegal for these two reasons, and that is whywe ask for Bakary's immediate reinstatement.Workers are not numbers or robots, and we do not want to be slaveseither. FRIBIN and other companies are attacking not only constitutionaland legal rights but, above all, human rights that protect us fromexploitation and mistreatment and that address the most basic needs ofany person: health, rest, family conciliation.
