The bill "to control immigration" debated in rapid procedure in Parliament can be
summed up in a few words: criminalization of foreigners, radicalization of thepractices of the prefectures, utilitarian vision of exiles. Nothing is good inthis project which only reinforces a systemic racism which reeks of the abjectstench of the colonial periods. The State fully assumes a racist, security andpopulation control policy. CRIMINALIZATION AND RADICALIZATION OF PREFECTORALPRACTICES. The Minister of the Interior clearly says that the prefects will beresponsible for "making impossible" the lives of foreigners, which is nothingnew: the defenders of exiles know how much the prefectures have been organizingfor a long time this policy. Some of these defenders, for fear of angering thestate (?), spoke of "dysfunction". This bill shows us that there is nodysfunction but the application of an ignoble political project.In this text, it would be a question of effectively implementing the OQTFs(obligation to leave French territory) by systematically linking them to IRTFs(prohibition of re-entry to French territory). The assimilation betweenforeigners and delinquency is recurrent in this text of law and in the words ofthe minister, clearly taking up the discourse of the far right! Thus, foreignersunder OQTF will have to be systematically registered on "the file of wantedpersons" making the OQTF a criminal sanction whereas for the moment it is "only"an administrative sanction. The Minister even suggests a "stay policy"! Beneaththis hazy statement, what is he thinking? A return to the colonial practices ofFrance in the 1930s, with the North African Brigade responsible for controllingforeigners on metropolitan territory, a distant ancestor of the BAC...With this law, it is the hunt for migrants that is open with a multiplication offacies checks. It is a way to pressure, control and monitor any population thatdoes not fall under the "white" criteria. This is confirmed with the "respect forthe values of the Republic", that is to say "personal freedom, freedom ofexpression and conscience, equality between women and men, the dignity of humanperson, the motto and the symbols of the Republic". Coming from a government thatdoes nothing about equality, whose members are accused of gender-based and sexualviolence and for whom human dignity is the last concern, we could laugh if theconsequences were not so tragic for foreigners!It is also the arbitrary power of the prefects already in place with their"discretionary power". This security policy will be reinforced with the taking offingerprints and photographs by the police and the gendarmerie without theconsent of the person concerned and which may even be done "under duress". Giventhe already well-established reputation of the police for their sensitivity to"human dignity", this law announces even more police violence covered up by theauthorities! And that's not counting the expansion and construction of newadministrative detention centers (CRA) where violence and abuse are increasingaway from the cameras.France, which already respected international conventions on migrants onlyhalf-heartedly, ended up sitting on them! Thus, the Council of Ministersspecifies that expulsions will be facilitated for delinquent foreigners, even ingood standing, and "the removal of foreigners in an irregular situation whoconstitute a serious threat to public order", even if they have family ties inFrance in both cases! However, for the prefectures, a threat to public orderbegins as soon as papers are supposedly false! The law calls into question theright to asylum, the reception of victims of violence, including children. Itreinforces the non-respect of the presumption of minority, allows the separationof children from their parents...A RACIST LAW AT THE SERVICE OF CAPITALISMThis state racism, which does not want to say its name, also serves as alegitimization for the division of the labor market. When the Minister says thatwe must "be nice to the good guys and mean to the bad guys" and that he is goingto regularize some workers in shortage occupations, make no mistake about it:according to this law, there is no there are only "bad guys". It is a question ofassigning populations to professions that no one wants because the wages andworking conditions are appalling. This overexploitation of racialized populationsand their assignment to certain trades is not new: it is the return of colonialpractices! If, unfortunately, this is not new, the government is bringing thepractice into law! Moreover, this new residence permit, from 1 to 4 years, doesnot guarantee anything to foreigners since they will always have the sword ofDamocles of the OQTF on their head if the job ends up being no longer in tension!The Darmanin law responds well to the interests of capitalism by sorting out thepopulations to affirm that a part will have neither the same rights nor the samefreedoms. This is discrimination!The law also provides for a "talent" residence permit to bring in doctors,nurses... This is a large-scale looting capitalism. On the one hand, poorcountries having to undergo the policies of the IMF which impose theprivatization of public services and push part of the hospital staff into thestreet. On the other hand, in rich countries, quota policies on these professionsto better attract "talent" from the South by paying them less than a "talent"from the North. These "talents" will even be able to bring their family, which isnot intended for a baker, not considered a "talent".The Minister also announces with his law that he will abolish all socialassistance to foreigners who are not in a regular situation. But it already is!By such declarations based on the prejudice that foreigners would come to Franceto benefit from aid, it serves the same soup as the far right and the right. Thisis only a strategy to better make his despicable project accepted by thepopulation! There is only state medical aid (AME) from which people in anirregular situation can benefit, but the senatorial right has just abolished itwithout any shame...Finally, this law and the racist practices of the state also offer an answer tothe crises of capitalism. Indeed, the survival of the latter passes for theruling class by a division of the working world. This state racism, theprejudices and stereotypes conveyed by the political class and many media areintended to divert the "poor whites" against the "even poorer racialized". Thesepolicies aim to avoid a confrontation with employers and their support, thestate.
