Let's analyze the key points of the new Security Decree, approved by the Council of Ministers on February 5, 2026, which affect freedom of assembly and movement (we're leaving aside here the so-called "anti-maranza" regulations on the use of knives, those relating to theft and robbery, the installation of video surveillance systems, and the "protection" of teachers treated as police officers, etc.).

RED ZONES: Already tested starting at the end of 2024 with a simple circular from Minister Piantedosi, they are now being institutionalized by law. The prefect can establish "red zones" for a maximum period of 6 months (renewable up to 18 months), from which a long list of individuals (even those simply reported in the past) are required to be removed. The urban DASPO (denied entry order) introduced by the Minniti Decree is also extended to those reported or convicted of crimes committed "during demonstrations in public places or places open to the public."

DEFERRED ARREST IN THE ACT OF DAMAGE: for anyone who has committed the crime of damage "during demonstrations in public places or places open to the public."

PENALTIES FOR DEMONSTRATIONS: Criminal penalties are replaced by very heavy fines. Failure to give advance notice of a demonstration risks a fine of between one thousand and ten thousand euros, rising to twelve thousand if the authorities' orders are not complied with (e.g., diverting the route of a march). Failure to comply with an order to disband the demonstration carries a penalty of between two thousand and twenty thousand euros. BAN ON PARTICIPATING IN PUBLIC DEMONSTRATIONS: The judge may order this following a conviction for a long list of crimes, including "violence or threats against a political, administrative, or judicial body or its individual members" (in practice, if you challenged a municipal councilor during a demonstration), or "personal injury," including against police officers. The convicted person may be required to report to the police station one or more times during demonstrations in which they are prohibited from participating.

The bleating of the parliamentary opposition is noteworthy. While the liberticidal laws on demonstrations were met with muted protests by the Democratic Party and Five Star Movement, on anti-migrant laws, these parties are blatantly following the right. In Emilia Romagna, the Democratic Party regional president, De Pascale, has expressed his willingness to build a CPR and collaborate "to improve the capacity to expel socially dangerous individuals." Only mass organization and mobilization can halt and reverse this security-related drift!
