The Meloni government's relentless production of repressive regulations has become unrelenting. "Security" has become the sole priority. A veritable panic is being fueled by amplifying (or inventing) alarming news stories to justify an increasingly dangerous security crackdown. People's real problems now seem to have disappeared: health, unemployment, starvation wages, workplace safety... If emergency rooms are understaffed and users are unsettled, the answer is not to increase healthcare funding, but to deploy security guards and increase penalties for those who attack healthcare workers (a solution now also adopted for school staff).
The pro-Askatasuna demonstration in Turin has given the government the opportunity to crack down again. While police violence against many protesters has been completely covered up (the few journalists who reported it were heavily reprimanded), the modest injuries sustained by some officers have served as the pretext for passing yet another Security Decree.
Let's analyze the key points of the new Security Decree, approved by the Council of Ministers on February 5, 2026, which affect freedom of assembly and movement (we're leaving aside here the so-called "anti-maranza" regulations on the use of knives, those relating to theft and robbery, the installation of video surveillance systems, and the "protection" of teachers treated as police officers, etc.).
RED ZONES: Already tested starting at the end of 2024 with a simple circular from Minister Piantedosi, they are now being institutionalized by law. The prefect can establish "red zones" for a maximum period of 6 months (renewable up to 18 months), from which a long list of individuals (even those simply reported in the past) are required to be removed. The urban DASPO (denied entry order) introduced by the Minniti Decree is also extended to those reported or convicted of crimes committed "during demonstrations in public places or places open to the public."
DEFERRED ARREST IN THE ACT OF DAMAGE: for anyone who has committed the crime of damage "during demonstrations in public places or places open to the public."
SEARCHES: "during demonstrations in public places or places open to the public" or in any case during operations "in places characterized by a significant influx of people," the police can search virtually anyone they wish.
PREVENTIVE DETENTION: "during demonstrations in a public place or open to the public," the police may "escort to their offices" and detain for 12 hours individuals who, based on even the slightest evidence, may appear dangerous. Remember that a "place open to the public" includes a cinema, a theater, or even a venue where a public meeting is being held.
FAILURE TO STOP AT A STOP SIGN: Anyone who fails to stop at a police stop sign and flees risks a criminal penalty ranging from 6 months to 5 years.
PENALTIES FOR DEMONSTRATIONS: Criminal penalties are replaced by very heavy fines. Failure to give advance notice of a demonstration risks a fine of between one thousand and ten thousand euros, rising to twelve thousand if the authorities' orders are not complied with (e.g., diverting the route of a march). Failure to comply with an order to disband the demonstration carries a penalty of between two thousand and twenty thousand euros. For "disturbing the peaceful conduct of a meeting in a public place," the fine ranges from EUR500 to EUR3,000. Even "seditious shouting and demonstrations" (?) risk EUR400 to EUR2,400.
BAN ON PARTICIPATING IN PUBLIC DEMONSTRATIONS: The judge may order this following a conviction for a long list of crimes, including "violence or threats against a political, administrative, or judicial body or its individual members" (in practice, if you challenged a municipal councilor during a demonstration), or "personal injury," including against police officers. The convicted person may be required to report to the police station one or more times during demonstrations in which they are prohibited from participating.
"CRIMINAL SHIELD": Police officers (but also ordinary citizens) who have committed a crime in self-defense, fulfillment of a duty, legitimate use of weapons, necessity, etc. They are not entered in the required register of suspects, but in a special "separate form" (it is not yet clear what the actual effects of this change will be; the stated goal is to guarantee impunity for the aforementioned individuals).
UNDERCOVER OPERATIONS: The possibility of operating "undercover" is also extended to prison police officers. It should be remembered that under the previous Security Decree, the secret services obtained authorization not only to infiltrate "terrorist" organizations, but even to found them (!)
MIGRANTS: Foreign citizens are required to cooperate in their own identification, and border rejection, expulsion, and repatriation procedures are simplified.
On this issue, the government has also drafted a shameful bill aimed, among other things, at limiting the ability of NGOs to rescue them at sea (the so-called "naval blockade"), in defiance of the most basic principles of humanity. The bleating of the parliamentary opposition is noteworthy. While the liberticidal laws on demonstrations were met with muted protests by the Democratic Party and Five Star Movement, on anti-migrant laws, these parties are blatantly following the right. In Emilia Romagna, the Democratic Party regional president, De Pascale, has expressed his willingness to build a CPR and collaborate "to improve the capacity to expel socially dangerous individuals." Only mass organization and mobilization can halt and reverse this security-related drift!
