What does it mean to affirm the injustice of a certain repressive treatment when
this is juridically configured and consolidated? This, which might seem like aquestion of little substance, is - in reality - more difficult than it appears.In fact, contesting a certain law and, in return, an institutional structure,involves a precise choice. In or against? Within the rules of the institutionalgame, made up of a specific linguistic as well as procedural code, or outside ofit and therefore before - and beyond - any formulation involving positive law?So, what to appeal to ..? ---- Let's look around: CPR, special surveillance,arrests of young social activists and students, violent and vengeful prison,repression of workers' struggles and grassroots trade unionists, policeintimidation... An endless list. But let's focus on the current Italian. Thereare countries where issues and events of political repression simply fade intothe background. No debate, no dialectic, no public opinion, no hype ordisappointment at any level. But if in Italy, on the other hand, the question ofprison has come to question such a large part of society, and decidedly not onlythat of the "powerless", it is because it represents a decisive "what" to thejuridical nature of the State. And here, then, the splits, the factions, theparties (here, the judiciary ..) who express themselves for often divergentinterests, elbowing each other in a ballroom of power where someone will have toclean up... And to clean up, often, they are those who fight by puttingthemselves on the line. However, as much as we can, let's not do the "dirty work"of power. And we say out loud that fighting means staying and being there evenwith the spotlight off. Staying means being able to continue to carry on one'sideas and arguments without fearing the exploitation that always rains down on us.More than anger we need intelligence, and a lot of it, to lucidly face thedynamics of power to which political and solidarity action is subjected on adaily basis. You need caution. Because, even with the best reasons, there isalways the risk, to be clearly recognized, of the "useful" and "functional"scapegoat. Repression is not just a stick, otherwise how easy it would be tohighlight its havoc! In fact, within the social field, a "repressive tolerance"can exist; that is, that form of veiled satisfaction with the expressions of thesquare that does the greatest good of the institutions, always in need of easilylabelable elements to cleanse themselves of social irresponsibility parexcellence. It is this that we must have the strength to continue to thematizeintelligently.
