by discredited and weak leaders, distant from the orientations of public
opinion in their countries.
Observing the limping start of the negotiations, one can believe that
the negotiations will be neither short nor simple and that a long time
will pass before the parties find an agreement, especially since, as was
logical to expect, in the meantime the war on the battlefield continues.
At the moment, for various reasons, the parties do not seem at all
convinced of the opportunity to reach an agreement: while Ukraine thinks
it can continue to resist, hoping for growing support from the group of
the willing and their direct involvement in the conflict, the Russians
have not yet abandoned the idea of resolving the issue on the
battlefield and are thinking of a new decisive spring-summer offensive
that will produce the collapse of the front and the strategic defeat of
the enemy.

The possible outcomes of the conflict

It is unfortunately a fact that no matter how things go, the European
Union will end up having Ukraine on its back, or at least what remains
of it, after having been well and truly exploited by Trump with regard
to the exploitation of its mineral and energy resources, with a ruined
and polluted territory, scattered with mines and explosives, with an
economy in pieces, with a population halved compared to before the
conflict, with an entire country to rebuild.
This means that an immense volume of resources will be needed to rebuild
the country and that the long-awaited Rome Conference scheduled for the
summer, on the reconstruction of Ukraine, instead of being the occasion
of a banquet in which the companies involved and investors divide up the
contracts for the reconstruction of the country, will constitute a
potential flop for those European and international investors who had
bet on the reconstruction of the country and the exploitation of its
natural resources. Not only that, but the most disastrous consequence of
the end of the war will be the implementation of the promise made to
Ukraine to join the European Union.
Given the current state of affairs, it is no exaggeration to say that
the probable entry of Ukraine into the Union will determine its failure
from both an economic and political point of view, at least as we have
known it up to now. Not only that, but this entry, if it happens, will
jeopardize the enlargement of the Union with respect to those European
countries that up to now are part of the so-called candidates, since it
will happen for Ukraine without conditions, penalizing the sacrifices of
those countries and peoples who have been waiting for years for their
request to be accepted. Not only that, but Ukraine's accession will
happen in clear, flagrant and evident violation of the founding Treaties
of the Union and of all the parameters used up to now to manage the
entry of new members. What will be clearly violated will be what was
decided both in Copenhagen and in Madrid, parameters that up to now have
constituted the essential conditions for accession.

Failure to comply with the criteria

The Treaty on European Union defines the conditions (Article 49) and
principles (Article 6, paragraph 1) that all countries wishing to become
members of the European Union must comply with. The criteria, known as
the "Copenhagen criteria", were established at the Copenhagen European
Council in 1993 and strengthened at the Madrid European Council in 1995.
We are referring to the presence of stable institutions that guarantee
democracy, the rule of law, human rights, respect for and protection of
minorities.
Ukraine is currently a country in which martial law prevails, given the
state of war.
This means that press censorship is present and operational, that
compulsory conscription is practiced, that the exercise of religious
freedom is prevented, as demonstrated by the legislation enacted and
concerning the canonical Orthodox Church, the country's historic
religious confession, today persecuted, as witnessed by the sentences of
the judiciary relating to the expropriation of places of worship of
religious communities and their devolution to another faith, supported
by the State; as can be seen from the lack of protection of minorities,
affected by punitive legislation that prohibits the speaking of
non-Ukrainian languages and their teaching, the existence of schools and
the right to education in the indigenous language of the populations.
This set of rules materializes in the clear and evident violation of
human rights.
The failure to adopt a reliable market economy in the country and the
inability to cope with market forces and competitive pressure within the
Union constitutes another of the requirements lacking in the country for
its integration to take place; It is quite clear that the disastrous war
economy in which Ukraine finds itself forced prevents the operation of a
reliable market and inhibits the ability to cope with market forces and
competitive pressure within the Union, so that any goods produced in the
country, if placed on the Community market of the Union countries,
produce, as is actually currently the case, a distortion of prices, to
the point of creating situations of unfair competition, induced and
aggravated by particular protective measures for goods coming from the
Ukrainian internal market. Not only that, but the particularly
disastrous conditions of the agricultural economy as well as the
industrial one, whose infrastructure has suffered war damage, end up
attracting privileged financing from the common funds of the Union which
have a negative impact on the equal and equal redistribution of common
resources compared to the other countries of the Union. As evidence of
the fears we have expressed, we cite the sale below cost of grain
shipments in transit on the internal EU market for export, immediately
sold off by the Ukrainians below cost, in competition and to the
detriment of EU farmers, which has already sparked furious protests from
Polish, German and Romanian farmers. This is not to mention the
incredible levels of pollution of agricultural products from Ukraine,
characterized by failure to comply with EU standards in the use of
fertilizers and fungicides and burdened by pollution from war events,
but regularly placed on the market in the name of solidarity with the
belligerent country.
It is also worth noting the very high level of corruption in the
country, accentuated by the war. It should be noted that according to
the index relating to the perception of corruption, reported by
Transparency Interventional, that of Ukraine has risen from 26.96 points
in 1998 to 36.00 points in 2023 and is growing further. The incidence of
corruption is aggravated by the bad habits resulting from the payment of
bribes to recruiting officials to avoid forced enlistment and by all
those phenomena connected to the war economy which, as is known, cause
undue enrichment and social resentment.

Violation of the Community aequis

Finally, accession to the Union requires the country that joins it to
have acquired the capacity to accept the obligations arising from
membership, including the capacity to effectively implement the rules,
norms and policies that constitute the body of Union law (the aequis),
as well as adherence to the objectives of the political, economic and
monetary union.
Ukraine's inability to satisfy, above all, the principles of the rule of
law is a dividing line that makes its incorporation into the European
Union illegitimate and impossible, not to mention that granting the
country a privileged and accelerated path to accession compared to other
candidate countries that for decades and with enormous effort have
created, with sacrifice, the conditions to be able to respect the
required parameters, undermines and nullifies the credibility of the
accession process, creating clear and strident inequalities.
It is also worth remembering that the war has produced a Ukrainian
diaspora of more than 10 million individuals, which constitutes a
significant burden with regard to their integration into the host
states. This exodus has taken on the characteristics of an anomalous and
atypical migration since, in order to prepare an emergency reception,
this has been financed by the European Union and individual states with
specific financial measures and legislative facilitations that have in
fact created a discrimination in favor of Ukrainian refugees,
determining a more favorable condition compared to the most
disadvantaged segments of the native population, generating very strong
reactions of resentment and revenge that have had repercussions on the
general political level. The widespread presence of Ukrainian refugees
fleeing the war, assisted by the solidarity shown by the States of the
Union, has created a growing climate of resentment and rejection towards
the Ukrainian cause, resulting in a general shift to the right of the
political axis that finds a synthesis in the growing refusal at a mass
level to support the war with further shipments of weapons. Those who
paid the price for this choice were above all the self-styled left-wing
and reformist parties that, by supporting the Ukrainian war effort,
ended up supporting the war, going against their traditional positions
that saw them against the use of war as a tool for resolving
international disputes. This choice by the left-wing parties has opened
up unexplored prairies for the political right, allowing far-right
parties everywhere to adopt the slogan of opposition to the war, in the
name of national interests, gathering consensus, especially since the
economic weight of the war effort of an undeclared war, but in fact
supported and financed, has had an impact on the material living
conditions of the less well-off classes and classes. The ever-increasing
evidence with which the political behavior of the Kiev government has
become known, the spread of warmongering attitudes, especially of some
European Union leaders, rancorous and politically inconsistent,
(emblematic is the case of the low representative of European foreign
policy Kaya Kallas or the vice president of the European Parliament Pina
Picierno - Russophobic), the incessant and biased propaganda of
journalists and members of the regime mainstream, of nationalist and
partisan analysts, have created a growing reaction of rejection towards
the positions of solidarity towards the Ukrainian government,
increasingly seen as an epigone of Putin's, to the point of generating
the awareness that the ongoing war sacrifices two brotherly peoples, but
is the fruit of two substantially identical oligarchies that fight each
other in the name and in defense of their own interests. Those of both
sides, in fact, are completely similar in their objectives and methods.
The fact remains that all these people, in defense of their unspeakable
and unspeakable interests, are sending two peoples to the slaughter,
producing more than a million dead and 4 million wounded and disabled,
sowing mourning and destruction in Ukraine as in Russia.
