In France, refusing such data collection is a crime, regardless of whether the initial offenses for which the person was arrested ultimately lead to a conviction. This is what is called an "autonomous" offense, and this is why "HW" is being charged. Acquitted of participating in the undeclared demonstration and refusing to provide his phone's passcode, he remains prosecuted only for refusing to provide his physical identification. During the proceedings, his lawyer decided to bring the case before the Court of Justice of the EU, so that it could analyze whether this data collection system, as provided for by French law, respects the rights and freedoms protected by the Charter of Fundamental Rights, particularly the right to privacy. The Court responded in the Comdribus judgment of March 19, which constitutes a resounding condemnation for France.

Firstly: taking photographs and fingerprints constitutes the processing of biometric data, which is considered "sensitive" data under European law. This type of processing is therefore prohibited in principle, and it is only "in cases of absolute necessity" that such processing can be implemented.

This notion of "absolute necessity" is very useful and protective because it means that the collection of fingerprints and photographs can never be systematic. Consequently, the processing of biometric data can only be permitted in a limited number of cases.

The Court's analysis therefore leads to the conclusion that the French framework for taking fingerprints and photographs is contrary to EU law because it fails to meet the requirement of absolute necessity.

Secondly, the Court of Justice of the European Union examines whether or not French law requires police officers to justify their decision to collect fingerprints and photographs. It requires that a clear explanation be provided to the person concerned, even if brief, to enable them to exercise their right of appeal. It adds that the fact that a judge can subsequently rule on the legality of the collection does not exempt the police from providing any explanation to the individual. Police officers never explain why they take fingerprints and photographs when a person is arrested or questioned. These practices have become commonplace in police stations, even for individuals being questioned without being detained or minors, according to testimonies from lawyers. This explains the staggering figures of 9 million photos in the TAJ (Automated Criminal Records System) and 6.5 million fingerprints in the FAED (Automated Fingerprint Identification System). Above all, Article 55-1 of the Code of Criminal Procedure is frequently used to put pressure on individuals who risk sanctions and detention if they refuse. It's also worth remembering that since 2022, fingerprinting can even be carried out by force!

In France, the collection of information on the population is not considered an exception but rather a way to cast the widest net possible. Practice clearly shows that if information is available or obtainable, the police take it "just in case," for later use. If someone is at the police station, they are required to provide their personal information. If someone is stopped and searched, they will be photographed and identified using facial recognition, even though this is illegal!

The Comdribus ruling therefore puts a stop to abusive and massive surveillance that has been in place for years. The Ministry of the Interior must break its silence, be held accountable, and order an immediate end to the systematic taking of fingerprints and photographs by the police. This landmark ruling must lead to a complete overhaul of the law and the deletion of the millions of illegitimate records currently contained in the TAJ and FAED databases. To be continued!

Murder of Olivio Gomes in Poissy in 2020:
The former BAC police officer was sentenced to ten years in prison in the first instance!

On October 17, 2020, three officers from the Paris night-shift Anti-Crime Squad (BAC) pursued a car for 30 kilometers after it had simply been speeding on the ring road. This police car even left its jurisdiction. They only notified their command center mid-journey and only activated their flashing lights after more than ten minutes. The three officers then signaled Olivio Gomes to exit the highway, which he did not do immediately.
He took the next exit and continued driving to his home in Poissy, where he stopped. Once parked, Olivio Gomes found himself blocked by the BAC car, which was tailgating his. Self-defense was not accepted as justification for the police officer's actions, as "the absence of harm to himself or others. His proximity to the victim at the time of the shooting (between 50 centimeters and 1 meter) and Olivio Gomes's behavior on the road, which suggested no danger," were among the factors considered to be working against him.
The court also noted the defendant's lack of empathy for the victim and the fact that he expressed no regret or remorse.
It should be noted that this murderer received no support from his colleagues or from the police hierarchy, which was absent from his trial. The benches of this assize court were occupied by Olivio's family and friends, as well as by victims of police violence or families who have lost a loved one during a police intervention. "Most families don't have a trial in the assize court," explained Leonel Gomes, Olivio's brother. En janvier, Macron réunissait les industriels français de la guerre pour leur demander «d'aller plus vite» dans la production. En juillet dernier, il leur demandait «d'innover plus rapidement, de produire plus rapidement, de produire de la masse nouvelle». Le message a été bien reçu en Sologne. Police brutality!
