Dear New Yorkers,

A dozen workers on the construction project in Midtown that sparked a sweeping emergency response and evacuation this week have alleged in lawsuits that they were seriously injured in accidents at the site before Tuesday’s chaos.

“I live with a lot of pain, still, in my everyday life,” said Diana Ruiz Cabrera, who tore several ligaments in her ankle when she slipped and fell from a step ladder in February. The single mom said she was taken to an urgent care clinic, continues to receive physical therapy for her injuries and has not been able to return to work since her accident.

City records indicate site safety managers hired by the project’s general contractor notified the Buildings Department of three accidents since May 2025. But The City Reporter found nine additional worker injuries, including Ruiz Cabrera’s, for which there is no record of such notification.

Three workers said they were struck by unsecured falling objects — including one who said a jackhammer landed on him from a floor above while it was being moved. Two other workers besides Ruiz Cabrera allege they were seriously hurt in ladder falls. None of those incidents were reported to the Department of Buildings. (The contractors did not respond to The City Reporter's questions.)

“If you go to the emergency room, you’ve got to report it, if you went to CityMD, you’ve gotta report it,” said Charlene Obernauer, executive director of the advocacy group New York Committee for Occupational Safety and Health. “Not doing so could result in a violation.”
