Dear New Yorkers,

A federal judge has ordered immigration officials to transfer a 17-year-old boy into the custody of the U.S. Department of Health and Human Services after his lawyers said he had been held for nearly two months in an immigrant detention center meant for adults.

The boy, referred to in legal filings as A.D., is originally from Guinea and had been living in a foster home on Long Island. He was arrested in mid-May by Suffolk County police for an assault and was placed in the custody of U.S. Immigration and Customs Enforcement.

In Manhattan federal court, his attorneys filed a petition seeking his release, but he had already been taken to the Moshannon Valley Processing Center in Pennsylvania.

“ICE mistakenly believes he is over 18 years old despite federal and state documents to the contrary,” they wrote at the time. “His detention in adult ICE detention contravenes federal law and is endangering his physical and mental wellbeing.”

Immigration officials refused to release A.D. in the ensuing weeks, leading to the judge’s ruling last Thursday. His lawyers said a clerical error resulted in his immigration detention at an adult facility. Children in ICE custody are supposed to be sent to the Office of Refugee Resettlement, which is overseen by HHS.
