Belgium :Group deportation to Kinshasa on 27th May 2014: Frontex flight?‏

On 27th May, a group of policemen wearing uniforms, accompanied with loads of civilians, invaded the yard of the 127 bis closed centre at 7 a.m.


Here are a few testimonies:

‘ – There was a lot of agitation on the weekend of 24-25 May, it was hell!

- The six Congolese, women and men, present for several months in the closed centre were isolated in one wing. During the whole weekend, others arrived in buses from the different Belgian centres, and then others from different European countries.

- The people to be deported were isolated in one wing and we were in ours, they made everything to isolate us so that we would not be able to see anything.

- On Tuesday at 7 a.m. the police invaded the yard of the 127 bis. We could not see anything because the buses were parked at the entrance of the centre.

- I just saw that there was a woman in a wheelchair among them.

- There was one big bus and two smaller buses.

And other testimonies that say a lot about the whole thing:

‘We can not say anything. I can not give you any information.

Contact with a deported Congolese in Kinshasa on 28th May 2014: ‘We now are at the airport for identification, we are about a hundred people…’ then the line was cut.

Various information in the flight: according to some detainees, they were between 90 and 100 Congolese, according to a worker from the centre they were 110, according to the Foreigners Office that was contacted by an association they ‘only’ were 19: 16 Congolese from Belgium, 3 from France, and one from the Grand-Duchy.

Belgium: Abused Migrant Women Fear Deportation


Legal Loopholes, Inadequate Shelter Access Send Women Back to Abusers

(Brussels) – The risk of deportation prevents many migrant women who experience domestic violence in Belgium from getting the protection they need, Human Rights Watch said in a report released today. The report was released in advance of Women’s Day in Belgium, November 11, 2012.



The women we interviewed face a terrible choice: endure abuse at the hands of a partner, or report the violence and risk deportation. Belgium needs to make sure that every woman who experiences domestic violence can get the help she needs, regardless of migrant status.
Liesl Gerntholtz, women’s rights directorThe 57-page report, “‘The Law was Against Me’: Migrant Women’s Access to Protection for Family Violence in Belgium,” found three major protection gaps for migrant women who experience domestic violence in that country. Women who migrate to Belgium to join a husband or partner may face deportation if they report the violence during the period when their status is being confirmed, as do undocumented migrant women. And domestic violence victims, especially undocumented women, lack adequate access to shelters“The women we interviewed face a terrible choice: endure abuse at the hands of a partner, or report the violence and risk deportation,” said Liesl Gerntholtz, women’s rights director at Human Rights Watch. “Belgium needs to make sure that every woman who experiences domestic violence can get the help she needs, regardless of migrant status.Belgium has passed laws and adopted policies to prevent, investigate, and prosecute domestic violence and protect victims, including a National Action Plan. But it has yet to fully address the gaps for migrant women, Human Rights Watch found. Belgium recently signed, but has yet to ratify, the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, which requires countries to ensure protection irrespective of migrant status.A law designed to permit women who migrate to Belgium to join a husband or partner to remain in the country does not protect women if they leave their abuser while their application for family migration is being processed, if they leave him without first telling the authorities, or if the partner leaves Belgium. Proving violence and meeting income requirements are also impediments, Human Rights Watch found.

Gökce, a Turkish woman with a 12-year-old son, who is also a Turkish national, fled her abusive husband but later felt compelled to return to him until her legal status was secure, her sister-in-law told Human Rights Watch.

Undocumented women are particularly vulnerable. Unauthorized stay in Belgium is a criminal offense and police are required to report anyone who they suspect is in the country illegally to immigration authorities. Women who do come forward have few avenues to obtaining legal status, especially if they do not have children. Ngalla, a 35-year-old undocumented woman from Cameroon, endured seven years of abuse at the hands of her husband, coming forward only when she obtained permanent residence through her Belgian children.

“I felt confident then,” she said, “because of my papers.”

Newly arrived migrant women are less likely to have support networks of family and friends, making them more dependent than other women on shelters to escape an abusive home. But Belgium lacks sufficient shelter spaces, forcing women to return to abusive homes.

Undocumented women face particular obstacles accessing shelters, which generally require women to contribute to the cost. Undocumented women who cannot do so are ineligible for financial support from local authorities available to other victims of domestic violence.

Jarmay, an undocumented woman from Ghana, told Human Rights Watch that she could find nowhere to stay and ended up living on the streets after escaping her “very violent” partner, who threatened to kill her.

The first time that Hayet, a 29-year-old Moroccan woman, fled her violent husband with her two children, who are both Moroccan nationals, shelter staff told her they had no space and suggested she stay with family. But with no family or friends to help her, Hayet and her children returned to live with her husband. They finally found shelter space when they fled a second time, after the violence flared again.

“No one should have to return to a violent home because they have nowhere else to go,” Gerntholtz said. “Women’s shelters should have enough resources so they don’t have to turn away women and children who need help.”

The report contains recommendations to the federal government, regions, and community authorities, including:
  • Ratify and implement the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence.
  • Reform the 1980 Law on Access to the Territory, Residence, Settlement and Removal of Foreigners so that undocumented migrant women who experience domestic violence may apply for a residence permit on humanitarian grounds and so that deportation is suspended until a decision is made on the application.
  • Reform the 1980 Law so that migrants, whose residency rights depend on their relationship with an abusive sponsor, may apply independently for a residence permit.
  • Make public funds available to ensure access to women’s shelters for victims of violence who need them, irrespective of migrant status.

On Tuesday, the British government will try to deport up to 60 people to Sri Lanka, where many of them are at serious risk of arrest, torture and even death.

Despite overwhelming evidence of torture,  mass deportations to Sri Lanka were resumed last year at the height of the genocide against the Tamils in the country.

Since then, three attempts to deport people to Sri Lanka have been disrupted by a combination of  legal action and direct action at the detention centres. We have physically stopped the coaches from leaving while lawyers won final-hour injunctions in court. During the last charter on 26th September – check date, a person locked themselves to the coach surrounded by supporters, holding it up for hours while 35 people gained injunctions stopping their deportations throughout the afternoon.

Together we have the power to stop deportations. If we keep up the pressure we can stop the charters to Sri Lanka. Join us on Tuesday to show solidarity to the deportees and fight the deportation machine.


Britian and the genocide in Sri Lanka

The genocide against the Tamils in Sri Lanka claimed the lives of over 100, 000 people in 2009 alone and continues to this day.

Many Tamil returnees to Sri Lanka have been detained and tortured to silence potential dissenters and to scare witnesses to war crimes

While the military occupation of Tamil lands is accelerating into a mass land grab, deportations from the UK are serving to mask this deadly situation.

The driving force behind the deportation of Tamil people are investment opportunities such as oil and gas exploration in the Tamil seas and the economic potential of the land. See for example interests pursued by greedy UK politicians and businesses like the Sri Lankan Development Trust set up by disgraced former Defence Minister Liam Fox.

There is clear evidence that the resumption of charter flights to Sri Lanka were arranged in a deal by Liam Fox, Adam Werritty and other fixers close to the Tory government.

Tamils who have fled the genocide in Sri Lanka have only found themselves terrorised again by the British government is working hand in glove with commercial interests.

A lot of young Afghans continue to be regularly deported for the last six months.

The Foreigners Office seem to have made a priority out of it!
DW is one of these persons deported without any mercy by the Foreigners Office.
He was not even 16 when he arrived to Belgium. His parents were killed when he was a child and he only has one sister left who is living in Afghanistan.
His asylum request was rejected and followed by an Order to leave the territory. A regularisation request is still in progress but it will not suspend the Order to leave the territory.
DW fulfills several regularisation criteria: he speaks Dutch fluently, he has been living here for 5 years, and he has had an undetermined contract for 3 years.
The Leuven police arrested him in July 2012 to bring him to the centre in Merksplas. He already experienced a first deportation attempt, which he refused.
W has been building his life here, all his friends are here, and he doesn’t know Afghanistan. He will not be able to join his sister because she is living in a war zone where all youngsters are immediately recruited by the Talibans.
W is desperate, he doesn’t know how to escape from this trap.

He will be taken to the closed centre 127bis on Sunday 30 September in the afternoon and he will be deported under escort on Monday 1 October on the KLM flight n° KL1722 to Amsterdam at 08:15 a.m. In Amsterdam he will be taken to another KLM flight n°451 to Abu Dhabi/Barhain at 01:40 p.m.
We oppose these arrests and deportations that are more and more violent and that increase every year.
We oppose this politics of “Get out!” “Good fences make good neighbours”. We refuse this planned world, where a majority have to endure war and famine so that a minority may live in peace.
We know the situation in Afghanistan. Millions of refugees fled the country to go to Iraq or Pakistan. About empty talks of politicians, abolishment of the right of asylum and deportations
While Politici@ans hold their concerned speeches infront of the cameras, talking about the progroms in Rostock (north Germany, 20 years ago), they at the same time do not want to mention the word progrom and are afraid of commemorative plaques. And behind the cameras they continue with their business of racist deportations.

And again in a fears way people are dragged out of their life to be deported. Some lived exactly this 20 years in Germany or have been born during the time of the progroms. Nevertheless the politics want to violently desplace them into another country - deport them.
Nothing has changed in this racists politics, it is only more silently, less obvious and less visible from the outside. The progroms in Rostock, Hoyerswerda (https://en.wikipedia.org/wiki/Riot_of_Hoyerswerda), Mölln and other cities in Germany in 1991/1992 where used to let pass more racist laws and the de-facto abolishment of the right of asylum 1993.

20 years ago or now, the people affected by racism have been left out, where not asked or even where found as the people in charge of what had happened. The ZAST (central housings for refugees) in Rostock-Lichtenhagen was overcrowded, instead of solutions the refugees where left alone, amongst them many Roma from Rumania. They were forced to camp without tents, washing possibilites or food infront of the ZAST. Political usefull stereoptype pictures where produced and used for deporting the people and the abolishment of the right of asylum in Germany. For the politicians the progroms where coming at the right time.

And the inhuman deportation machine is continuing. At this time or now, no sign of taking responsibility. In a capitalistic system the nation needs the splitting up of the society, creating "the others". While some people should belong to the society, "the others" should not, this leads to stigmatisation and discrimination. This does not talk about human people.

Big protest - during holiday time?! Your ideas are needed!

Until now there had been always protest at the Airport Düsseldorf. Because of holiday and illness, there won´t be many people?. But who knows, maybe there will be spontaneous protests? There are many possibilities: at the airport, infront of local foreigner offices or in the inner city. Protest can be broad and different, what ever you feel like doikng.
Be creative, be active, organise yourself in affinitiy groups and come to the Airport Düsseldorf or make the protest visible in your city. Maybe you want to announce your own demo? Just mail to us!
Banners hanging from bridges, visits of Air Berlin offices, observing your local foreigners office, there are many possibilities. And for sure the Airport Düsseldorf will always be thankful for help in public advertising their deportation collaboration...

At Terminal B, in the Airport there are the holiday check in desk from Air Berlin.
At Airport Düsseldorf there had always been smaller and bigger manifestations, the airport and police reacted from very easygoing to nerveous and repressive. They do not like too much publicity . This is the same with Air Berlin, one of the main deportation Airlines, working for FRONTEX.
