Uitbreiding minnelijke schikking in vraag gesteld

De Liga overweegt een procedure op te starten voor de Raad van State om de vernietiging te bekomen van de gemeenschappelijke omzendbrief van de minister van Justitie en het College van procureurs-generaal met betrekking tot de verruimde minnelijke schikking inzake strafzaken.

In een gemeenschappelijke omzendbrief, die zaterdag in De Tijd werd onthuld, geven de minister van Justitie en het College van procureurs-generaal, magistraten van het Openbaar Ministerie (OM) instructies over het toepassen van artikel 216bis van het Wetboek van Strafvordering, waarin op 14 april en 11 juli 2011 de minnelijke schikking in strafzaken wettelijk wordt geregeld. Zonder tromgeroffel, zonder noemenswaardig parlementair of maatschappelijk debat, krijgt het OM het alleenrecht om wat voor reden dan ook minnelijke schikkingen voor te stellen voor misdrijven waarop tot 20 jaar cel staat. Het gaat om een stille revolutie waarbij zowel onderzoeksrechters als strafrechters in feite vleugellam worden gemaakt. Het OM kan  grote gerechtelijke fraudeonderzoeken zomaar afbreken en de onderzoeksrechter volledig buiten spel zetten. Het OM kan zelfs een uitspraak van de strafrechter overrulen. De rondzendbrief benadrukt in dat verband dat het OM een lagere geldboete kan voorstellen indien ‘bijzondere omstandigheden’ dit rechtvaardigen. Aldus vlijt het OM zich neer op de stoel van de strafrechter en neemt diens rechtsprekende functie over. Een ongeziene aantasting van het grondwettelijk beginsel van de onafhankelijkheid van de rechter. Doordat het OM eigenhandig en binnenskamers over de opportuniteit en de hoogte van de geldboete beslist, loeren willekeur en klassenjustitie om de hoek.

De ene fraudeur krijgt een minnelijke schikking. De andere niet. De omzendbrief benadrukt dat het OM een geldboete moet voorstellen die rekening houdt met de zwaarte van de feiten. Individuele parketmagistraten hebben daarover zo hun eigen mening. Al bij al dreigt de verruiming van de minnelijke schikking een zegen te worden voor grote fraudeurs. De omzendbrief geeft ten indicatieve titel aan dat bij fiscale misdrijven gedacht kan worden aan een geldboete die 10% van de ontdoken belasting/bijdrage voor natuurlijke personen en 15% voor rechtspersonen beloopt. Zo kunnen tientallen miljoenen verdwijnen in de zakken van grote fraudeurs, terwijl constant wordt geschreeuwd om een harde aanpak van kleine criminaliteit of overlast. Dit alles kan gemakkelijk leiden tot een klassenjustitie, minstens tot een justitie met twee snelheden. Vermogende fraudeurs kunnen met hun geldbuidel rammelen om hun blanco strafblad te behouden, terwijl heel gewone burgers die niet over een dikke portemonnee beschikken, achter slot en grendel verdwijnen. Armoede wordt aldus tot een soort verzwarende omstandigheid verheven. De Raad van State drong erop aan dat het parlement, de wetgevende macht, zou bepalen welke misdrijven al dan niet voor een minnelijke schikking in aanmerking zouden komen. De minister van Justitie wees dit van de hand om de beoordelingsvrijheid van het OM intact te houden. Daarom wordt nu aan de omzendbrief een indrukwekkende ‘indicatieve lijst’ van misdrijven toegevoegd waarvan de straf kan worden afgekocht. Het gaat niet alleen om financiële en fiscale misdrijven maar ook om misdrijven zoals smaad, diefstal zonder geweld, bendevorming, opzettelijke slagen en verwondingen zonder ziekte of ernstige arbeidsongeschiktheid, valsheid in geschrifte, corruptie, oplichting, heling en witwassen. Alleen misdrijven die ‘een zware aantasting van de lichamelijke integriteit’ inhouden, komen niet in aanmerking voor een minnelijke schikking. Een wazig begrip waarover alleen het OM oordeelt. De Liga vindt dat het niet toekomt aan een minister of een College van procureurs-generaal om in de plaats van het parlement aan te duiden welke misdrijven voor een minnelijke schikking in aanmerking komen. Het is een slechte manier om justitie naar de 21ste eeuw te tillen en om het vertrouwen van het publiek in het gerecht te herstellen. Dat vertrouwen zal er niet komen zolang niet wordt uitgegaan van rechtsgelijkheid en onafhankelijkheid van de rechter.

PROCESOS DE CAMBIOS EN AMÉRICA LATINA Y SOCIALISMO DEL SIGLO XXI

Conférence donnée par Mr Rafael Correa, président de l’Equateur, à L’Université Catholique de Louvain-la-Neuve. Un compte-rendu de Melissa et Christophe, des membres d'intal.








Ce jeudi 26 novembre 2009, à l’occasion d’un passage de deux jours en Belgique ponctué de rencontres avec les personnalités traditionnelles du monde politique belge, Mr Rafael Correa, président de l’Equateur, nous a fait l’honneur de donner une conférence intitulée « Les processus de changements en Amérique Latine et le Socialisme du 21ème siècle » au sein des murs de L’Université Catholique de Louvain-la-neuve (UCL) ; université à laquelle il porte un attachement particulier pour la bonne et simple raison qu’il y fut étudiant, et y rencontra sa future épouse.



 La conférence fut introduite par Mr Bruno Delvaux, recteur de l’UCL, qui rappela les 3 missions de l’université : enseigner, rechercher, et rendre service à la société. Il s’adressa d’abord aux étudiants présents, en leur soulignant l’importance de s’engager afin de rendre le monde meilleur et de lutter contre les inégalités qui malheureusement n’y sont que trop nombreuses, puis s’adressa à Mr Correa en le félicitant d’être cet exemple d’engagement, et lui rappela à titre anecdotique la prédiction que ce dernier avait un jour dit en blaguant lors de sa vie estudiantine : « Un jour, je serai président d’Equateur ! ». Croyait-il si bien dire ?
Mr le Président prit alors la parole et donna sans attendre le ton de son discours : « Le but de cette conférence est de défier les présomptions de la théorie économique dominante et sa réalisation en Amérique Latine. »

Il analysa premièrement l’implication du Fond Monétaire International dans son pays, en dénonçant son cruel manque d’objectivité politique et économique, et ses directives très éloignées de la réalité des besoins du peuple équatorien. Mr Correa n’hésite pas à remettre en cause la légitimité de cette institution financière internationale, qui prit unilatéralement des mesures économiques ultralibérales pour les gouvernements latino-américains lors du « Consensus » de Washington, auquel, paradoxalement, les gouvernements concernés n’ont pas été conviés à participer. Il demanda également pourquoi n’avait-on jamais songé à remettre en cause la théorie générale de l’économie de marché à la vue des résultats désastreux, ne serait-ce que d’un point de vue social, de ces politiques.

Après la mise en lumière des rouages de l’hégémonie étatsunienne sur les pays du sud, via ce moyen de pression et de subordination qu’est le FMI, Mr Correa précisa que c’est ce modèle politique qui a amené à la situation actuelle de non-développement de l’Amérique latine.

Mais « un vent de changement souffle désormais sur l’Amérique Latine ». En effet, Mr le Président observe qu’aujourd’hui « les gens osent penser leur avenir par eux-mêmes, et commencent à construire cette société où l’être humain est placé au cœur des préoccupations ». Ce Socialisme du XXI Siècle, comme le définit Mr Correa, est ce qui guide sa pensée politique. Selon lui, ce mouvement se caractérise par un profond humanisme, un sens profond de l’éthique, une conviction démocratique totale et une volonté de garder constamment un esprit critique sur le monde. Conscient de l’image « d’amas d’idées populistes » que les médias occidentaux donnent sur ce courant, il tient à dénoncer le phénomène de média-mensonges qui manipulent l’opinion publique et lui enlèvent toute objectivité. Pour lui, c’est au contraire un programme d’émancipation certes en constante construction et mutation, mais créatif. C’est cette capacité de s’adapter à la réalité de chaque région et chaque pays de l’Amérique latine qui en fait une de ses principales vertus.

Pour approfondir l’explication du socialisme du XXI siècle, Mr Correa se permit de faire une comparaison avec ce qu’il qualifie de « socialisme traditionnel ».

Tout d’abord, il partage avec le socialisme traditionnel cette opposition au néolibéralisme, et rehausse également l’importance de l’action collective et du rôle de l’Etat, « absent pendant cette triste nuit néolibérale ». Il a également la préoccupation pour la justice dans toutes ses dimensions : sociales, ethniques, régionales intergénérationnelles. Cette préoccupation est d’autant plus importante que l’Amérique latine est le continent le plus inéquitable du monde.

Cependant, le socialisme moderne tel que l’entend le président comporte également d’importantes différences avec le socialisme traditionnel. Selon lui, l’idée de matérialisme analytique est dépassée car elle s’est révélée être un échec face au dogme libéral. Il est également opposé à la théorie de la lutte des classes et à la violence que celle-ci entraîne. Pour lui, « la seule arme valable est le processus électoral. C’est grâce au vote des équatoriens que ce socialisme du XXI s’est imposé légitimement et a gagné 7 processus électoraux consécutifs ».

Mais la première différence cruciale entre ces deux socialismes concerne l’appartenance des moyens de production : tandis que le socialisme traditionnel souhaite étatiser ceux-ci, le socialisme du XXI siècle propose quant à lui que ce soient les « zones stratégiques » qui soient contrôlées par l’Etat.

En conclusion, on peut dire que la conférence de Mr Correa a dénoncé les ravages de notre système économique dans les pays du sud, et a annoncé la fin de ce règne néolibéral destructeur pour faire place à la construction d’une nouvelle ère, caractérisée par la réponse aux besoins des gens et non à ceux du profit. L’Amérique latine se donne aujourd’hui les moyens de ses ambitions en se détachant du modèle économique dominant et en se prenant elle-même en main via des forces alternatives telles que l’ALBA. Malgré les tentatives de contre-attaque par les Etats-Unis, comme le témoigne le coup d’Etat au Honduras, nous nous permettons de porter nos espoirs dans ce combat pour la création d’une société nouvelle, enfin débarrassée de toutes ces injustices et inégalités.

Stroompannes dreigen door te veel zon

Het zonnige pinksterweekend heeft er bijna toe geleid dat ons elektriciteitsnetwerk het begaf. “In de zomer dreigen meer van dit soort noodsituaties”, waarschuwt hoogspanningsbeheerder Elia.

Ons land stond afgelopen weekend dicht bij een black-out, het uitvallen van het totale elektriciteitsnetwerk. “Het was extreem zonnig en er was veel wind, waardoor een massa zonne- en windenergie werd opgewekt”, legt Lise Mulpas van Elia uit.

“Tegelijkertijd werd weinig energie verbruikt, onder meer omdat heel wat bedrijven stillagen. Om te voorkomen dat het volledige Belgische elektriciteitsnetwerk overbelast zou worden en het daardoor zou begeven, hebben we een deel van die energie moeten ‘evacueren’ naar Frankrijk.”

"We hebben een deel van de energie verkocht aan Frankrijk, tegen het normale prijstarief. Nederland en Duitsland hadden immers hetzelfde probleem als wij. Daar zaten ze door het goede weer ook met een groot overschot aan energie."

Meer flexibel

Door de grote toename van zonnepanelen dreigen er deze zomer nog meer zulke noodsituaties te ontstaan. Elia eist daarom meer flexibiliteit om de elektriciteitsproductie in de klassieke centrales tijdelijk te kunnen verminderen in geval van nood.

Zoniet wordt volgens Elia de kans op een ‘Italië-scenario’ een stuk groter. Daar viel in 2003 het volledige elektriciteitsnetwerk uit, waardoor het hele land zonder stroom zat.

N-VA wil nieuwe kerncentrale, Groen reageert met ongeloof

N-VA is voorstander van een nieuwe kerncentrale op thorium in ons land. Dat stelt Kamerlid Bert Wollants woensdag in zijn "totaalvisie" om de prijzen en de bevoorradingszekerheid van energie onder controle te houden.

Indien mogelijk wil N-VA de levensduur van alle huidige kerncentrales ook éénmalig met tien jaar verlengen, al pleit de partij wel voor een geleidelijke afbouw van kernenergie.

"N-VA is voor de afbouw van kernenergie, maar tegen de kernuitstap zoals ze nu voorligt. Ze is een luxe die ons land zich op dit moment nog niet kan permitteren", aldus Wollants. Als het veilig kan, wil hij ook de oudste kerncentrales dus nog tot 2025 openhouden. Dat moet ademruimte geven om de hernieuwbare energiemarkt uit te bouwen en voldoende back-upcapaciteit te voorzien.

De N-VA wil daarnaast één nieuwe kerncentrale bouwen, wat moet helpen om tot een geleidelijke afbouw van kernenergie te komen. Zo'n centrale op de splijtstof thorium "zal aanzienlijk veiliger zijn en genereert ook minder kernafval", aldus Wollants. Het nog langer openhouden van de bestaande kerncentrales zal volgens hem immers meer kernafval produceren, de uitbouw van nieuwe veiligheidsmaatregelen verhinderen en de positie van Electrabel versterken.

Calvo

Groen-Kamerlid Kristof Calvo reageert alvast vol ongeloof. "Iedereen in Europa kiest voor kernuitstap en hernieuwbare energie" luidt het in een reactie aan Belga. Calvo verwijst ook naar de kerncentrales in opbouw in het Franse Flamanville en het Finse Olkiluoto, waar de vertragingen enorm zijn en het kostenplaatje de pan uitswingt. Dat een partij die in Vlaamse regering zit met dergelijk voorstel uitpakt, is een bewijs waarom het energiebeleid in België zo slecht is, besluit hij.

Voor Wollants maakt het voorstel echter deel uit van een "totaalvisie" die maximaal inzet op hernieuwbare energie. Hij benadrukt dat onze energiemix volgens de huidige plannen in 2020 nog steeds voor drie kwart uit niet-hernieuwbare bronnen zal bestaan.

Man blijkt vrouw na ziekenhuisonderzoek

Een Amerikaan ging voor een niersteenonderzoek naar het ziekenhuis.  Na een bizarre ontdekking, stapte hij het hospitaal uit als vrouw. Dokters vonden tijdens het onderzoek vrouwelijke geslachtdelen in het lichaam van Steve Crecelius. Dat meldt de Huffington Post.

De vader van 6 kinderen maakte een afspraak bij het ziekenhuis, omdat hij last van een niersteen. Toen de resultaten van de echografie binnenliepen, werd de vader verteld dat hij in feite 'interseksueel' is, wat zoveel betekent als geboren met zowel mannelijke als vrouwelijke kenmerken.

Nu gaat Steve trouwens als Stevie door het leven. Debbie Crecelius, Stevie's vrouw, geeft toe dat het tijd vergt om te wennen aan de situatie. "Hier heb ik niet voor getekend, maar wie uitendelijk wel?", merkt ze op. "Binnenin is ze nog steeds dezelfde persoon als toen ze nog een man was." Ook de kinderen staan open voor Stevie's geslachtswijziging.

In addition to the regular locations of joint struggles anarchists against the wall  initiative were involved with the struggle against the racist attacks on the African refugees. Within Israel were actions in solidarity with the Bedouins who are subject to creeping transfer lately accelerated. In Tel Aviv and Jerusalem it was mainly with the refugees and social justice. In the occupied west bank of Palestine it was the fifth yearof Al-Ma'asara, Beit Ummar for the sixth year, in Bilin now already in the eighth year of continued struggle, in Nabi Saleh already the third year, in Ni'ilin that is just completing the fourth year, in Quaddum that started this year, and the Sheikh Jarraneighborhood of occupied east Jerusalem-Al-Quds already in the third year.

Activists are reporting that on average 1500 teargas cannisters are fired by the Israeli Occupation Forces in Nabi Saleh every Friday. To day is very hot and the IOF teargas has set the mountain and other grass areas on fire. Unarmed protestors are currently under fire, with IOF firing teargas, rubber bullets and spraying skunk. Lots of teargas and smoke from fires. At least one person has been report as being unconscious as a result of being overwhelmed by teargas and taken to an ambulance.  "We are gradually making our way closer to the spring with intervals of sitting and singing."

"Friday the -25/5 about 200 Palestinians, 4 Israelis and five international marched in the weekly demonstration against blocking the main access road to Nablus - the county city. Following the road blocking and expansion of Kdumim colonial settlement, excess to 11,00 dunnam (2750 acres) of farmland the village was blocked. Thus, the villagers appealed to the Israeli High Court and subsequently won their case. The court held that the roadshould be opened, but the army did not comply with it and declared the road closed for 
safety of travelers... (Strangely, the health and safety of the Palestinians became very important to the army...) Just after that step, the villagers began to protest against the illegal closure of the road. Like every week the army placed a barrier at the entrance to the village to block Israeli and other participants from out of the village to come to the 
demo, but we passed around it easily through the agricultural area. The demonstration began ceremoniously as usual, walked toward the soldiers who were waiting in invaded homes in the village near the road. It continued with shouting at the soldiers with megaphone, with music, and dancing. soon after that began an exchange of tear gas shooting and thrown stones in response. Canisters of tear gas were fired directly into the crowd and five protesters was directly hit by these and two of them were evacuated to hospital in Qalqilya. The skunk spraying car stayed by and made sorties from time to time to the improvised road block prepared by the demonstrators. When it could not hit the demonstrators, it sprayed in stead the houses and the fruit trees around it "generosity".
At the same time, two teams of troops began moving from the hills surrounding the village  into the olive groves and there too developed exchange of stones and tear gas. Some two hours later, the soldiers began to retreat pursued by the youth of the village with theirs houts of victory and stone throwing.
After the soldiers exited from the area of ??the village back to the settlement of Kedumim, the protesters advanced up the road, burned tires as a sign of victory blackened the air of the settlement of Kedumim (the wind was friendly to us and took the black smoke directly to the settlement. On the road one can clearly see burn marks from previous demos one further than the other... it seems that every demonstration advance more and more forward and liberate another part of the road and also challenging the occupation soldiers. This time the youngsters reached a point very close to the expansion of the Qdumim colonial settlement and set there fire to the last tire."

Getting the Voice Out is een website die getuigenissen verzamelt van personen die worden vastgehouden in gesloten centra om zo hun verhalen buiten de muren bekend te maken en publiek te maken wat de autoriteiten proberen te verbergen.
 
- Lees de nieuwe getuigenissen HIER.

- Nieuwe rubriek: 'Uitzetting aan de gang'. In deze rubriek plaatsen we alle oproepen  bij uitwijzingen op de luchthaven. Dit om  over een klein deel van de realiteit van de uitzettingsmachine te informeren.

- Het nieuws uit de gesloten centra van de laatste twee weken lees je HIER.

- HIER vind je een nieuwe pagina waarop we meerdere video's uit verschillende Europese landen plaatsen van uitzettingen met het vliegtuig.

- We hebben tevens een bankrekening geopend waarop je om onze website te ondersteunen, kan overschrijven met volgende mededeling: GETTINGTHEVOICEOUT. Het geld is nodig om telefoonkaarten te kunnen betalen. HIER

Tot slot, de rubrieken 'Films' en 'Radio' zijn nog altijd toegankelijk en we kunnen jullie suggesties om hen af te werken nog steeds gebruiken.
